As to © violations - I believe a direct "look" copy could be construed as an infringment. Don't you think Coke would squash anyone who made a soda can that looked like theirs?

The question is what you consider a "direct look" copy? The main reason why the two look similar is the use of grey and black borders. The reason why EyeFetch picked gray had nothing to do with DPC, though. It was purely because it is the most "neutral" color, and avoids colorful distractions when looking at images.

Also, look at the rest of the web. Do Google results look different from MSN results? Does Orbitz flight searches look different from Expedia's flight searches? Or what about Flickr and 23hq.com? What about Friendster and Orkut? What about Match.com and True.com? I could go on for hours. And Coke and Pepsi? Come on....tell me they don't copy each others designs constantly when a new flavor comes out.

As far as I am concerned, you have no reason to even have to explain yourself. There will always be those that go with the flow, and those that strive to row against it. It's really of no matter.

FWIW, I love the site, and am happy to be aboard!

Actually, that's one of the rules we are going to drop with the next rules update. If it weren't for the lawyers of this world, we would have updated our rules weeks ago, but we needed a clean pass from our legal counsel before we could push out the new rules, and lawyers can take their sweet time when they wordsmith :)

Congrats on the site. You'll have your loyalists just like DPC has it's loyalists. I'm not a professional and couldn't care less what site I view images on - I just like to see good shots. I do think that there are more people willing to help you out on DPC and aren't just trying to get their photo ratings boosted like psig. Heck, you can go to that site and 5 good images with 50 views and no comments or critiques will be on the front page, but an overexposed badly processed nude woman will get 3 thumbs up from 20 people.

That rant being said, I think you need to rethink your rules change on the text being allowed in images. There are a few photographers who could take a shot with their lens cap on and if they were allowed to put their name on the photo they'd place higher solely because of friendship. It's just human nature to take care of your buddies but it's unfair to others.

Good luck with the site.

hrmm ... interesting thread. First they copy the site, the idea, the wording of the rules, the layout, then they allow their members to take our photos and our titles, re-shoot them, then enter them into the challenges there.

I propose a challenge...

dpchallenge vs. eyefetch.

I'll let you all pick what we compete in. We'll meet wherever...we'll give them home field advantage if they want it. Whatever floats their boat. The losing site has to shut down and become slaves to the other site for eternity.

Yeah...maybe I should let things die, and if you have no idea what transpired over there in the last day, then more power to you. I think they should get sued for copying dpc and I think that the members that are guilty of stealing people's photos and titles should be banned from the earth and maybe placed in a jail on another planet or something. I've never met a group of more ungrateful, inbred doofuses in my entire life.

If you're curious as to what it is...it's basically a site that copied off of dpc. It's currently haven to all of the dpc rejects and outcasts that have been banned for being retards, banned for cheating, and just plain not intelligent enough to belong to a site where the members have any trace of intellectual values to their names. The only place with a lower average IQ would have to be the sea life that gathers as the very depths of the caspian sea. Of course it's also haven to amateurs who aren't skilled enough to use a search engine properly and somehow stumbled onto their site before arriving at a real photography site and now worship those very outcasts and rejects as if they were gods.

Dude what is your problem? I thought you were "flattered" that someone copied your shot. I guess not.

Oh and what was this thread about?

Photo copies on the site.
03/16/2007 02:32:40 AM · #58
dunno, I can't read it...I've been banned. Maybe you can refresh my memory. Don't be a reject yanko...be a team dpc'er.

Totally uncalled for David.
You behaved like an immature child there a short while ago, were rude, foul-mouthed and found yourself in a corner without a following you were so trying to rally up, then openly cursed the site's Admin. Now you come back here, name-calling and full of accusations that are unfounded, and I take offense to your harsh words here.

Just chill.
Take a few days off or kick back with a brew, prop your feet up and relax.

I'm not out of line here. I didn't swear at anyone or anything along those lines. I'm perfectly within my rights to not only form my opinion of the goings on there but to express my findings here on this forum. Maybe you favor censorship over the right to share ones opinion openly, but me, personally, I prefer the latter.

edit: don't try to draw a tainted picture here either brad. I was not over there trying to stir up trouble. Anyone who has some common sense can click that link and follow along to see for themselves. The guy stole photos from here and what some members there refer to as a cult following who worship him. And you're right, I did swear at the admin when everyone started saying that I should be banned. I have no intention of ever submitting a photo to a site that not only allows plagiarism, but was built by plagiarism itself. It was easier to get banned than it was to click a few links and delete my account, so that is the route that I chose.

I would like to add that I did include a disclaimer that my actions and words in no way represented the community here at dpc.

Ideas maybe, photos ? No.

So very wrong again David. Eyefetch has a zero tolerance for stolen images, just as DPC does. The site itself, though a photo-sharing community with contests/challenges, is actually very different than DPC and also trying very hard to not be a knock-off.

Take a few minutes and read this:
DPChallenge as a coffee shop We are all on the same side.

That was in reference to the above post that brad said was out of line. You have confirmed what I've known all along...mostpeople don't read posts before they reply. If you had you would see where I said I swore at Paradigm.

The proof is in the pudding my friend. I'm done with this thread...said what I needed to say. Reply all you want, you'll just be helping my post stay at the top of the recent posts section where more people will see it...win-win for me. peace

No I read it correctly. YOU then changed it in your edit. In your edit you retracted the statement, "I didn't swear at anyone" by admitting you did swear at "Paradigm". Maybe try reading your own posts? Better chance of not contradicting yourself that way.

For someone who's flattered rather than upset, you sure have a strange way of showing it....
03/16/2007 03:21:03 AM · #69
well there is one difference i saw, they have somebody called rikki!

Hey David - for what it's worth, I'm concerned about you.
Looks like you've had a pretty rough day and probably feel fairly vulnerable right now.

Do me a favor?
Remove any ammo from your guns and tuck them away for a few days.
Just for safety's sake.

Deal?

You can say Eyefetch has Rikki'd DPC.
03/16/2007 07:22:47 AM · #72
Well well... I had a little surf round the site and came across this familiar user with his familiar images.

Is that a problem Craigester? Guess what...I am on there too! And I am also on heaps of other sites. Isn't that allowed?
03/16/2007 07:32:03 AM · #74
It was just interesting to see some familiar users. I am not complaining about it... I haven't looked elsewhere personally.
03/16/2007 07:34:15 AM · #75
Okay no worries. I was just curious as to your point...but it is okay. You will find many DPC'ers on other sites...we are like a family so to speak. And like any family you always have different personalities...and clashes. But that is what makes us all unique.
