Where does it say it is illegal to still someones skeletons?

I had a guy email me saying he was copying it for his own site, but that's illegal. You can look at a site and if you like it, design something similar, but you can't outright copy it's coding. That's like publishing a book with your name on it that someone else has written. |

Then why didn't you just say that in the first place?
So, what are you going to do? Sue him? Hunt him down and threaten him with miscellaneous, unrelated phrases? |

If you stole someone's skeleton, their body would collapse in a pile of goo. That's why. |

| I just have to add that it's quite amusing that this entertaining exchange is all found under a thread titled "Website Etiquette." Maybe I'm the only one who sees the humor in that though, being that I'm an oddball and all. :o) |

I'm not a lawyer, but as a software developer, I thought I'd chime in:
I believe it is a violation of copyright law if someone copies html code from your website, not "illegal" in the sense of a crime punishable by prison terms.
But as with all copyright type protection, if they substantially change it before publishing, then it may not be protected. Since you are talking about the website's template, it could substantially altered before someone else could use it, and you may not be protected. In order to be protected for the "coding" flow itself (e.g., the algorithms, for example, of any procedural code) you would need a patent. Then there's the matter of where your developer's got the template themselves. Most developers keep the rights to their own code so they can reuse it. So don't be surprised to see others using your site design.
Then again, the digital millenium copyright act might have changed all of the above.
Personally, you have to ask yourself what you are trying to protect for your site and how much you are willing to spend to protect it.
The most prudent thing you could do is simply to put a note on your site saying that all code is copyright. You have that about your photographs, but not your code. That is, if you own the copyright (as it may be owned by the developer).

You directed it directly to Spaz. That was the violation.

Thanks for the web info (see above and next page).
I think my designer may be talking more on the lines of 'ethical' abuse than legal abuse.
Thanks again!

I ment to delete that part in my post, I missed it, and now has been re-quoted. I saw you retract your statement, so I retracted mine.

If I have cancer would that make it acceptable? Since I do, then I'll assume that it is. |
AND???????????????????????????????????????????????????
People say things they shouldn't and when they apologize or feel bad they are put on display like that????? I retracted it because I shouldn't have said it, not that it isn't true, but it's not appropriate. Are you familiar with inappropriate posts? Um....
|

If there was NO OPTION to edit posts, you would be stuck with the thoughtless words that came out of your mouth. How about stopping and thinking clearly for a few moments before you hit the old "post" button on your post TO THE PUBLIC FORUM THAT IS THE INTERNET and you might be able to avoid post hoc "edits" after you have had sober second thoughts or sobering thoughts imposed upon you by the replies you get.
Just a thought on ETIQUETTE. ;)

There are many fine articles on copyright and copyright infringement. Here's a basic one available on the web: //www.bitlaw.com/internet/webpage.html
It might be good to keep in mind that copyright usually applies to content (i.e. "copy") and not to structure, per se. Content includes such things as written word, images and (for the web) scripting. If you have a structural design that you want to protect, you would apply for a patent.
So, for example, what's in a book is copyrighted (text) but the binding, the kind of paper it's printed on, its layout are all open to imitation. You can write a book in the "X for Dummies" style, print it the same font on the same kind of paper, bind it with the same kind of cover, give it the same title, and probably even use the same color scheme. What you "can't" do is duplicate the content (copyright infringement) or use the Dummies' logo (Trademark infringment).
Disclaimer #1: A copyright is only a right. If you never assert that right, meaning sue your infringers, it's worthless. It only keeps the honest people honest.
Disclaimer #2: There are things called "fair use" laws which allow people to make public presentations, within limitations, of your published work. (That's why libraries can freely circulate one copy of someone's book to hundreds of people as long as they do it one patron at a time.)
Disclaimer #3: I'm not a lawyer. I've been just been facinated by the many people I've encountered over the years yelling "No fair!" without understanding some of the above.
Disclaimer #4: I realize this is not where this thread has gone, but someone had to say it. ;p
