This is just my opinion, so take this with a grain of salt, but I think this would have been much better without the lit ground so prominent... Had you been able to isolate just the tree being lit with the black background (from a much lower perspective for instance), I feel this would have been much stronger. Of course it would be a completely different shot, and not what you were going for... So, pay no attention to me :)

there are a few spooky photos on here and this one is very nice...this may be neat with a scary leg stepping into the shot from the shadows...

I can't say this is one of my favorites. I am not sure why.. perhaps it doesn't hold my interest, I am not sure i see anything sharp.. what am i to look at. If the image was of fall colors of the tree, perhaps a closer shot of the tree or some leaves might be good... or a tighter crop. Perhaps it would be interesting if the shot was taken from farther back, where the street light (?) is in the center with the black of the night around it and the tree.

This would have been much more effective if the trame was framing the right side and there was a contrast between the light and the night.
