hey!

i've just started submitting some shots to jones soda to see about getting on one of their labels.

(for anyone who doesn't know, Jones Soda has a marketing gimmick where they put people's photographs on the labels of their bottles)

so, consider this a pathetic plea to drive some traffic to my shots (my first shot is here). please make me look good!

I send them something occassionally -- once even got an Honorable Mention. Two DPCers (that I know of) have actually had their photos printed on labels, although I heard that actually obtaining one was hard. Good luck!

Search the forums for "Jones" or "soda" or "Label" and you'll probably find them ...

I can't find the information on the site as far as what rights they get for your photo. By submitting are you 'giving away the farm' so to speak? What about if you are chosen?

No, they have a reasonable deal ... You do give them a royalty-free license to use the photo on the website/labels in exchange for the photo credit on the printed materials, and I think some printed samples. You retain all other rights in the photo except the ability to sell it exclusively to someone else.

But dig around before you submit; if you can't find the agreement then you shouldn't do it ... and I won't anymore either!

The actual agreement is on the submission form ... so you don't read it until you've sign up. I've copied it and pasted it below (note the timeliness of the last provision):

LEGAL AGREEMENT and PHOTOGRAPHER RELEASE FORM:

I _________________ :

{CHECKBOX} hereby grant Jones Soda Co. an irrevocable license to use my enclosed photograph(s) now or at any time in the future, throughout the world in any manner it so chooses and in any medium now know or later developed. This includes, the right to modify the photograph(s) as necessary in Jones Soda Co.̢۪s sole discretion. This also includes, without limitation, use on Jones Soda or Jones Naturals labels, carrier packs, magazine advertisements, corporate brochures, websites, and any other promotional material it wishes. I acknowledge that Jones Soda Co. is under no obligation to use my photograph(s).

By signing this form (clicking on the checkbox above), I agree that Jones Soda Co. will credit my photograph(s) with my name, as provided below, wherever it uses the photograph(s). Such credit will appear in a form similar to the following, which such form may be changed by Jones Soda Co. in its sole discretion:

"PHOTO #, NAME OF PHOTOGRAPHER, CITY, STATE/PROVINCE".

The current credit is printed vertically, in upper case letters, at the bottom left of the photograph(s). The current type size is approximately 1/16 of an inch in height.

I agree that there are to be no fees, commissions or royalties paid to me for the use of the photograph(s).

I acknowledge and agree that any and all persons in the photograph(s) (including the undersigned) must be identified by full name and must have signed the attached Model Release Form (please download, complete and fax back).

I acknowledge and agree that I am the owner of the enclosed photographs and that I have the exclusive right and authority to grant the licenses granted herein.

I understand that all submissions that do not include a self-addressed stamped envelope will be destroyed one year after receipt.

Jones Soda Co. is not responsible for lost or damaged photos.

{CHECKBOX} Allow others to use this photo for a myJones label with credit given to the photographer shown above. I also agree that there are to be no fees, commissions or royalties paid to me for the use of the photograph(s).

{CHECKBOX} Will remember to call my mother.

I understand that by submitting this form, I agree that I have read the terms of use and will abide by them.

yeah, so what i read from what GeneralE posted above is that i'm giving them rights to do as they choose, but that doesn't take away from my rights in any way.

i can't say i'm all that worried about it. i just wanna be on a damned soda bottle. ;)

You seem to have a better handle on the kind of photos they like than I do.

A hint: they print more B+W labels than they do full-color labels.

you guys rock!

when i was in high school, a bunch of us tried really hard to get on one of those "Dear Snapple Lady" commercials. we got close, but never actually got on. (remember those? get a commercial on the air and win a lifetime supply of snapple!)

while that dream faded, getting a shot on a jones soda bottle would be a close second ;) keep voting! :D
