My local newspaper has a photo contest (strictly for amateur photographers) which includes seven prizes of trips to Florida of various durations (value $1200 to $3400). This makes it very tempting to enter, but the rules include the following:

"The copyright in any submission shall remain the property of the entrants, but entry into this promotion constitutes entrant's irrevocable and perpetual permission and consent, without further compensation or attribution, to use, reproduce, print, publish, transmit, distribute, sell, perform, adapt, enhance or display such submission for any purpose, including but not limited to editorial, advertising, trade, commercial and publicity purposes by the sponsor and/or others authorized by the sponsor, in any and all media now in existence or hereinafter created, through the world, for the duration or the copyright in the submission. Sponsor and/or others authorized by the sponsor shall have the right to edit, adapt and modify the submission."

I would consider this in exchange for a trip to Florida, but it seems to apply to all entries, not just the winners. Is it worth entering with these rules?

I only would enter if I didnt care if my photo was used for anything. Otherwise I would say HECK NO! (which in my case is the case)

It does apply to all entries - and yes it is too steep a price IMHO. A few years ago, I had had a discussion with some online fellow artists - the thinking is that it is more of a WIN for the company sponsoring the contest....they get to pay out one or three winners and they get a good crop of photos to use free of charge for any marketing they need for the future.

So, like Jaimie said if you don't care much about your picture and/or do not mind NOT having photo credit for a picture you took then enter. But anytime I see contest rules where just entering transfers ownership to the company I walk away.

I pretty much feel the same, but it depends on whether the "perpetual license" is restricted to the function and promotion of the site -- at it is here at DPC -- or includes the commercial and sublicensing rights included in the cited contest rules.

In this case, you are basically making a free contribution to their library of stock images.

It depends on how much you'd like the trip.

I know sometimes I pay $10 for a raffle ticket to help a charity, knowing that I will not win... and taking a photograph that I'll never sell anyway and entering it in a competition with the chance to win something I want... Well, I'd do it.

I haven't lost anything. I would have enjoyed the shoot...AND it would thrill me that they liked my image enought to use it no matter whether I won or not.

It all depends on how stuck on the legistics you are or if you're just willing to give a little and have some fun. :)

That's the part I'm never sure about, and if it's so bad it'd never sell, what chance does it have of winning a competition? In the meantime, they can take your picture, paint on a moustache, add a funny caption, and sell T-shirts ... :-(

Pretty much my feelings too, which is why I entered Tourism Victoria's contest in '07. I didn't win anything but I did get to see my work in print, with credit, so for me it was definitely worth it :D (Though the permissions weren't quite that open-ended.)

I just don't get that excited about the whole copyright thing. If you want to give it a go, and think it'd look nice as an ad somewhere that you may never have gotten the exposure otherwise, go for it.

It's your image to do with as you please.......so do as you please. You still get to keep it, and you're only releasing it to this comany....for use.

The people who get worried about the open-ended part of a clause like that shoulddn't let the image go.

So only you know whether or not to enter.......best of luck if you do!

They run a contest almost the same here yearly and I entered 2 photo's in the first year and got two highly commended which I was pretty proud of as professionals were involved as well.

What I did was to only enter prints even though entering a high quality digital was an option.

I did however receive a book containing prints & names of all entries and winners which was kinda nice and I also know that my photos went on tour at least to China the sister city of where I entered.

Thanks everyone for the feedback.

Why is the contest not open to professional photographers? Probably in part because they would not accept these terms anyway.
