For those of you who don't listen to the Podcasts I thought I'd through out this little tidbit about Facebook and why you should leave your photo's off Facebook. This is an excerpt from the Facebook TOS
"When you post User Content to the Site, you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the User Content on the Site. By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorize sublicenses of the foregoing."

good info, these eula's are getting ridiculous and lawyers are starting to sue companies because of them stating that large corps have a unfair advantage because of their cashflow and teams of lawyers

I actually emailed facebook about the images. They responded basically: We will never use your photos without your permission first. I asked for this in writing since I'm a photographer. They responded basically: No. When I asked why, they responded: "We would have to send letters out to everyone who wanted it this way." I responded with: "Why not just change the terms then?" No answer yet...that was 6 months ago I think.

The unfortunat part is that they're too big to care now... Would they use your photo's without asking??? my guess is that if they thought it was good enough for an add... YES they would, and when you did complain they'd say you agreed to the TOS and you should have gotten it in writing saying they wouldn't.
hence it's better to keep your photo's off :) that is unless you want them stolen :) |

Those terms don't seem at all ususual or unnecessary for the purpose. With which part of those terms do you take issue?

I guess I'm not too keen on the thought that a shot of mine could end up being used in an add without even a mention of the fact I took it... frankly I do think it's unecessary for them to write into the TOS that they can use anything for any reason... what's the point? |

From DPC's User Agreement:
6.2 You hereby grant DPChallenge.com a nonexclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise any rights you have in the Member Information and Media, and otherwise to make use of the Member Information and Media (including publishing, disseminating, broadcasting, manipulating, reproducing, editing, translating, performing, modifying, or displaying any part of the Member Information) and/or Media alone or as part of other work in any form, media, or technology whether now new known or hereafter developed, to enable DPChallenge.com to continue the specific operation or marketing of the site. This includes, but is certainly not limited to email "newsletters."

Not that that makes me feel any better at all... (and I did read the TOS before joining) but on a Photography site like this
a) I come with the expectation that publication may happen (when one day I get on that front page)
b) I've seen the steps taken to make sure that my photo's arn't just stolen
c) Given this community I'm sure the Lang man knows what kind of uproar would happen if he did
I'm not aying that it isn't a common thing... but as photographers we can be choosy about where our stuff goes... I would gather it's much more likely that Facebook would steal an image than here... I would hope |

and that was just someone's personal photo's... that bad enough... let's say it was a photo of one of your clients that was stolen... |

AHahaha!
I was just cruising around the net and found my "Slipmoticons" are still posted on my old webspace at an old ISP I quit over two years ago, or was it three?
