Does anyone know what the site rules are regarding the use of tobacco or alcohol products as subjects in challenge entries? I canĂ¢€™t seem to find any specific rules or regulations regarding these subjects but recall some previous discussion in the forums where alcohol advertisement was mentioned as being in breach of the terms and conditions. |

4.2 You will not use the DPChallenge.com Service to post content or to design, manufacture, market or sell a Product that (i) infringes the rights of a third party, including, without limitation, copyrights, trademarks, patents, trade secrets, rights of privacy and publicity, (ii) is libelous, defamatory or slanderous, (iii) condones, promotes, contains or links to warez, cracks, hacks or similar utilities or programs, (iv) contains explicitly sexual content, (v) does or may denigrate or offend any ethnic, racial, gender, religious or other protected group, through use of language, images, stereotypical depiction or otherwise, (vi) is designed to or does harass, threaten, defame or abuse others, (vii) exploits images or the likeness of minors, (viii) encourages the use of drugs or the under-age use of alcohol or cigarettes or (ix) is generally offensive or in bad taste.

Thanks Leroy. Interesting it only say's the use of drugs or the under-age use of alcohol or cigarettes
From what I understand of this we can not use any product or brand name ? surely many entries have been in breach of that rule ?
What I was hoping to enter was someone drinking a well known brand of beer but may have to rethink this. |

We had an entire Beer and Soft Drink Advertising challenge. I think you'll be fine with the brand name beer as long as the consumer is of legal age :-D

An excellent question, indeed. I would assume that all legal statements should be taken in the context of where the site is hosted, which is the state of Virginia in the US. Here, the drinking age is 21.
That said, it seems reasonable for the Langdon and Drew (the real site owners, not the SC) to put an age in the terms of service instead of a phrase like "under-age" which has different meanings, or no meaning, in various worldwide locations.
To that end, I'll submit the suggestion to the SC.

Though it isn't illegal in Virginia to view a picture of a 16 year old legally drinking in the UK, is it ? |

You'd have to ask Langdon and Drew why they included it. I'm guessing it was less a legal question than one of their personal tastes. Anyway, I reported my own post to get the SC to note the thread, so hopefully one of 'em will pop in and pass along the issue to Langdon.

I am no lawyer, but in the end, I think the law comes down to where the website is.
In this case, you have stated it correctly. Under 21 drinking, under 18 smoking (or is that just a NC thing?).
As far as a European 16 yo drinking, I have no idea. If pressed, we may have to base the decision on the law, here.
eta: If I remember correctly, when the ToS were drafted, it was on the advice of a lawyer that it was included.

That would explain our crappy roads. Of course, "we" also produce alot of the tobacco. |
