I have made a number of suggestions to the rules redrafting exercise. I thought it might be helpful to post an alternative version showing an alternative version of what the revised rules could look like.
I think that my suggested format is more accessible (even if a little longer), because it reflects the way that the rules will be read by newcomers - in stages as they go through the DPChallenge competition entry stages.
I think that my version of requiring people to comply with the spirit of the rules is more clear than the new draft and avoids the need to call upon the "description of a typical viewer", which I think is bound to cause dissent.
I am a little limited by the limited amount of formatting available in the forum (headings should be made a little clearer using font sizes).

Challenge Rules (Legalbeagle suggested draft)
1. OVERVIEW
You must comply with the DPChallenge Terms of Use.
Any of these rules may be overridden by the âExtra Rulesâ section of the Challenge Details.
Basic Editing permits overall adjustments to help polish your captured image. These rules are intended to allow you to fine tune your entry and correct basic imperfections in exposure, contrast, color, etc. No selections or spot editing tools are allowed, with the sole exception of cloning out sensor dust or hot pixels.
Advanced Editing allows more freedom than Basic Editing to correct flaws and make the most of your captured image. Selections, layers and selective editing tools are allowed for touch-up and enhancement only. You may not create new features or obscure significant parts of your original capture.
2. TAKING YOUR PHOTO
You MUST:
⢠take the photo after the challenge is announced and before the deadline, based on the Current Server Time (US Eastern Standard Time) displayed at the bottom of every page on this site.
⢠use a digital camera that records EXIF data.
⢠ensure that your camera date and time are correctly set to your local time zone before shooting your entry. If the date recorded in your original image file is not within the specified challenge dates, your entry will be disqualified â NO exceptions! If your photo was taken in a different location than indicated in your profile, please note the location in the submission form so that we can adjust accordingly.
⢠take the image yourself. Someone else may press the shutter button if you set up the shot and the camera settings.
⢠retain your original, unedited file (exactly as recorded by your camera). Files that have been saved or altered with any editing or transfer software are NOT originals.
You MAY:
⢠use any feature of your camera while photographing your entry.
3. EDITING YOUR IMAGE
All post processing must be carried out within the spirit of the relevant editing rules (as described in the Overview above). Excessive editing with the effect of creating new effects or radically altering objects or the subject matter of the image (even if the tool or its use would ordinarily be acceptable, and regardless of whether you intended the change when the photograph was taken) may be grounds for disqualification.
You MUST:
⢠Post-process the image yourself. No one else may post-process your entry for you. Exceptions must be approved by the Site Council in advance.
⢠create your entry from a single file generated by your camera.
The file you submit MUST be:
⢠a JPEG (.jpg) file.
⢠no larger than 150 KB (153,600 bytes).
⢠at least 160 pixels, and no more than 640 pixels on each side.
You MAY:
⢠crop, rotate and resize your entry.
⢠add a border to the outside edge of your entry. Your border must be distinct and clearly recognizable as a border.
⢠include existing images or artwork as part of your composition as long as the entry does not appear to consist entirely of a pre-existing photograph in order to circumvent date or editing rules or fool the voters into thinking you actually captured the original photograph.
Basic Editing:
. . . . ⢠use RAW conversion software as long as the changes are made globally to a single file on one layer.
. . . . ⢠use Adjustment Layers (or their equivalent). An Adjustment Layer is a special type of layer containing no image data that lets you experiment with color and tonal adjustments without permanently modifying the pixels. Adjustment Layers must be applied in Normal mode.
. . . . ⢠apply filters or stand-alone utilities designed to preserve image integrity (such as Neat Image, Unsharp Mask, Dust & Scratches, and color correction tools). These filters must be applied uniformly to the entire image, and must not be used in such a way that their use becomes a feature. No "effects" filters may be applied to your image, with the exception of Noise and Gaussian Blur.
. . . . ⢠saturate, desaturate or change the colors of your entry, but no selections are allowed.
. . . . ⢠use a cloning tool or healing brush for the sole purpose of removing sensor dust or hot pixels. No other spot-editing is allowed.
Advanced Editing:
. . . . ⢠use RAW conversion software.
. . . . ⢠overlay two copies of the same original file and process them differently to enhance dynamic range.
. . . . ⢠use layers, layer masks, and alternative layer modes.
. . . . ⢠apply filters, effects, dodge & burn, and other tools to all or part of your entry.
. . . . ⢠saturate, desaturate or change the colors of your entry or part or all of any existing object within it.
. . . . ⢠use software to correct perspective, lens defects, or minor misalignments.
. . . . ⢠use a cloning tool or healing brush to clone out incidental power lines, twigs, dust specks, stray hairs, and similar minor imperfections.
You MAY NOT:
⢠use ANY editing tool to create new image area, objects or features (such as lens flare or motion) that didn't already exist in your original capture.
⢠add graphics, clip art, computer-rendered images or parts of other photographs to your entry or its border during editing.
⢠add text to your entry or its border during editing. This includes copyright statements.
Basic Editing:
. . . . ⢠distort or stretch your image in any way.
. . . . ⢠use the marquee, lasso, or similar tool to select a portion of your image for any reason other than cropping or creating a border.
4. SUBMISSION AND POST SUBMISSION
You MUST
⢠provide a copy of the unedited, original file to the Site Council along with a list of your editing steps within 48 hours of any validation request. This notice with instructions will be sent to your listed email address, and will also appear on the left side of your DPChallenge home page when you are logged in.
You MAY:
⢠request removal of your own entry during the voting period IF none of your last 25 entries were disqualified or removed, and no rules were violated.
You MAY NOT:
⢠submit a photograph depicting male or female genitalia, or acts of sex deemed inappropriate by a majority of the Site Council.
⢠hold more than one DPChallenge account, ask anyone to vote on your behalf, or link to your entryâs voting page.
⢠submit more than one entry per challenge.
⢠use the same original image in more than one challenge.
5. DISQUALIFICATION
Entries that violate the letter or spirit of these rules will be disqualified. All disqualifications are determined by majority vote of the Site Council. If you have any questions, you should err on the side of caution or contact the Site Council before submitting your entry.
In order to discourage repeated disqualifications and abuse of the disqualification system, the following penalties will apply for repeat disqualifications:
⢠1st DQ in last 25 submissions: No penalty
⢠2nd DQ in last 25 submissions: 1 week suspension of submission privileges
⢠3rd DQ in last 25 submissions: 2 week suspension of submission privileges
⢠4th DQ in last 25 submissions: 4 week suspension of submission privileges and 3 months of required âpre-submissionâ of proof file.
The above penalties will be applied only after review by the Site Council. In exceptional circumstances, the Site Council may elect not to apply a penalty.
If a user is found to have intentionally violated these rules, further penalties may be applied.

This is certainly clear. I do like the format better than the current one, as it is cleaner and easier to follow, with everything bulleted out. I also like that the rules for both are in the same place, but well differentiated.

You just can't expect the SC and the Administrators to please everyone all the time.
Don't get me wrong, your version is just fine, it's just to me they read the same.
