She (her lawyers) can probably use the "parody" defense ...
Besides, the guy's a fool for taking this approach. He should grab some Madonna "publicity materials" and use them to publicize his dad's stuff to a whole new audience. Far from being "damaged" by this resurrection of his dad's work, my guess is that the value would more likely be enhanced. |

From her previous work, it is probably true that she did copy the images or try to recreate them.
I doubt it is co-incidental. Question is, if the original artist made the images so well or so effectively or so popular that they are worth copying or imitating - why shouldn't they get recognition or renumeration for that?
And if she didn't copy it, or if the images are so common that anyone could have come up with them, then its nonsense and there should be plenty of examples prior to this of the same things being done.
But if they are original enough and creative enough to be unique and iconic and worthy of copying - that's what copyright is all about...

Quite the contrary. Using that approach, he can only reach the people that happen to stroll by and see the material. He is also risking a suit from Madonna for using her image for publicity. Doing it this way, he is associating the video to his father's photography and telling the world about it.
My predicition, (as though it mattered), is that he will eventually drop the suit and smile all the way to the bank. |
