Is there a legal burning Action for PS that will be ok in basic editing?

No, gothic glow uses several selection tools.

If you mean legal for Basic, it is doubtful, since the whole idea is to amalgamate and hide within a single sequence a series of underlying steps which would themselves, individually, be illegal.

Continue the burn and save it for the best of 2006 challenge.

I don't use third party actions so I'm not aware of any but what exactly are you trying to accomplish? Are you trying to darken the blacks or midtones? If so selective color applied to blacks or neutrals could help. That along with shadow/highlights, channel mixer and funky curve adjustments could do the trick. That's what I usually use instead of dodge/burn since those are destructive to the pixels and don't act as adjustment layers.

Edited to add: Here is a thread I started the other day regarding one of my photos which to me has a dodge/burn look to it without using the dodge/burn tools. Mind you not everything I did to the image is legal in basic or advance editing but just ignore that.
