guess he didnt read it either. The person who did this happens to live about 8 houses down from me and I was over at his house hours before he listed this, he told me all about it. I figured nobody would be dumb enough to lay out 700 dollars for something they didnt even read.

What about the fact that this was listed in the category "Video Games > Systems" instead of under "Art > Photographic Images"? Or the fact that under the format description he has it listed "Item Specifics - Video Game Systems" and implies it comes with "Bundled Items:
Accessories, Game(s"?

Im sure I can find you thousands of examples where the seller placed the item in the wrong category on purpose to sell it, however, they are not being kicked off ebay for that. read the discription of what youre getting, not the category heading.

harrison -- I'm quite curious. Do you know why he posted it? For a joke or did he really hope to get some "free" money?

Isn't selling the picture a copyright violation of some sort as well? Doesn't he have to have the rights to the likeness in order to sell the image?

No, it looks like he took the picture. It is not just of an Xbox. It has a light bulb and a background. It could be considered his artistic interpretation of the product.
But we plainly see from an eyewitness, so there is no mistake, that there was genuine intent to deceive. The arguement that "they should have read the add better" is mute given this new information.

There is no deception, it clearly says multiple times, you are bidding on a picture.

How is there no deception? That is bullcrap. It's already been established in this thread that he's done multiple things to deceive the careless browser. I suppose he put it in the video game console category, said it included bundled accessories (which it didn't), and included all of the system specs just for kicks? You've got to be kidding me. If you truly think that you are just rationalizing.

But it's very sly about it. The part where it mentions it's a picture takes up one line. The rest is devoted to how hot the xbox 360 system is this holiday season and how great the system is and goes on to list all of the system specs for well over 50 lines. It doesn't take a rocket scientist to see the sellers intentions.

Anyone who deliberately tries to sneak money out of someone else's pockets is a complete and total scumbag, end of story. This is exactly the kind of BS that is ruining the potential of the Internet, and why some people have given up any and all trust in the web.
Just had a web design client of mine call today because she got a $400-something bill from someone claiming that they owed money for their "Internet listing." I've seen tons of these messages ("ICLS" is one such scam company), with every indication that they're sending a bill, and if you get out your handy electron microscope you'll see "this is not a bill" buried in there somewhere.
I have zero patience for anyone who pulls this kind of crap. |

I would still have thought that that was what he intended to do. There were ten active bidders and another ten who looked closer later and retracted thier bids. Granted these were mostly bidders new to eBay, but that is still a lot of people to have bid on something none of them would have bid on had they known what they were really bidding on.
What it comes down to, and I see this reflected in many of the comments in this very thread, is that sellers like your friend make eBay a place to be very wary of. Kind of like Christmas shopping in the South Bronx. This not only hurts the "idiots" and "fools" who bid on the crap, but honest sellers like myself. We all become suspect just because we sell on eBay with people like mrsnugglecow. As this was some of those "idiots" and fools" first encounter with eBay many of them might never come back.

Not to mention that they waste peoples time. Even the ones who are diligent have to read through that crap when they are looking for something they want or need. My time is worth more then money to me.

$650 for a picture isn't the biggest farce on Ebay involving the Xbox 360. Check out this auction which certainly looks completely legit--no misleading whatsoever, and look what the idiot bidders took it up to? That's the level of stupidity we are looking at here. $650 for a picture? Evidently that's a bargain... |

read the description of the auction here and then tell me if the person who bought it isn't the biggest idiot ever:
//cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=8236595474
$611 and this guy was really blatant that it was an empty box. people are SOOO stupid. rtfd, man. rtf description. $600 is not something to play around with.

I am now convinced that a portion of the people who use eBay are either illiterate, stupid, or both. They must not be able to read. $600 for both a photo and an empty box. Geeze.... All I know is I've bought 3 lenses off eBay, and when I was looking, I read EVERYTHING, and if any part of it felt funny, I skipped that sale and kept looking. As far as the box goes, I feel no sympathy for whoever bought it. Now the picture sale, I agree that it was low, I couldn't sleep if it had been me selling it, but someone was pretty dumb to fall for it.
It's like the tell us in grade school people, when we took tests - read it all!
