OK, fair enough, but your image was associated with you, which hardly constitutes stealing. We come down hard on members who swipe an image and claim it as their own on another website (or this one). In this case, it sounds like somebody simply used your photo to represent you (still not illegal). You didn't appreciate it, so Manic removed the image as appropriate.
My images have been used in good fun as have countless others on this site. Essentially everybody knows where the original came from and who it belonged to. You might not have been amused, but you'd still have a hard time with a copyright infringement case, and I'm sure that person didn't expect you to be offended given your own publicity about the situation. |

Actually, I think it could be classed as a fair usage under 'parody' rather than copyright theft, but that's going off the point. The DPC Fanatics chatroom is a website that is run by myself on my servers, and has no direct affiliation with DPC (ie D&L aren't responsible for it) - the fact that I offer access to it for DPC users is by my personal choice. If you see a DPC image being used on another site, you contact the administrators of both sites, and let them deal with it. In this case, I've dealt with the chatroom side by removing the image, and the SC and D&L are all aware of the issues at hand and are welcome to investigate things at their end.

I was serious in that I couldn't remember who it was. However, you didn't ask me to take the image down at the time, and I didn't realise that you had serious issues with the image's use - if you'd informed me that you were displeased with the image I would have acted upon it then, but since you seemed to show amusement I assumed you were OK with it. As soon as I received your request (via PM) to remove it, I did.

The intention of the user who created it was that it would be a joke. The whole point of not telling you was that it was supposed to be a funny surprise for you. It wasn't in any way intended to be a private joke, or to embarrass you. I'm sorry that the original intent wasn't clear to you, and that you didn't find this amusing.

As I said above, it was done in that same sense of fun as when you were thinking about the tshirts. But since the image has been removed, what more can be done here exactly?

Full public understanding of all that is involved will do a lot more to clear the air than the locking of threads, and telling people to use PM. Leaving so many questions unanswered leads people to think that someone is trying to hide something. How about it SC? Please let the whole truth roll out into full view without any BS.
Although we all have heard repeatedly that DPCFanatics is not affiliated with dpc, it's not like that chat room was an entirely independant, self-sufficient entity. DPCFanatics owes it's existence to dpc, and depends on dpc as it's source (probably it's sole source) of members. The fact that it's administrator/moderator/owner is a member of our Site Council is at least an unofficial afiliation. And it could potentially lead to a situation with the appearance of a conflict of interest. With the operator of that chat room holding a position of authority here at dpc there is an implicit sanction, or condonation, of the actities there. I wouldn't want to be the lawyer trying to defend the "unafiliated and therefore no control" stance if someone who felt abused in DPCFanatics brought a lawsuit against dpc.
Disclaimer: I have never visited DPCFanatics, and no know very little about what is said there.

Agreed. Nothing more to be said. If what Alienyst wanted was an apology, he's gotten it several times. What really bothers me is that last night he was having a ball showing off the smiley and now he says he didn't find any humor in it. But I guess to each their own.

My conversations in private with admins who were present at the time would show I was not pleased. As I said, would anger have gotten me further? Probably not. The smiley was posted by others to me more than I posted it.

And no, I am not satisified that nothing more needs to be said or done. I will leave that to Alienyst.
The excuses given by a couple of SC members as to why the use was permissable are ..... lame. Look at the bottom of this page. The image was used without permission.

Well, people get drunk and dance on tables with lampshades on their heads...and later regret it.
I wasn't in chat last night, so I won't try to defend or explain anything Alienyst might have said or done. But surely you can understand that, after the fact, a person may have second thoughts or feel differently about what happened. Just think of all those people "surpised" on national tv shows--such as "While You Were Out" or "What Not to Wear" Do you think, when put on the spot, most of us would act any differently? I don't. We accept the situation as it comes, perhaps try to be a good sport....then upon reflection, we wish we'd stood up for ourselves.
Just something to think about. |

Ok, then. According to this logic, everyone who participated in this thread are bold-faced thieves who should be hung by their thumbs. Everyone who participated in that thread borrowed images from all over the net for a joke. Nobody complaiend about that.
Same thing here. Tons of people "stole" images to participate in this activity. No one complained there either. You don't see people writing in "OMG, you stole my hair/guy mowing lawn/ Yoda photo".

Well, I shall say that if it does have anything to do with DPC Fanatics, I would probably agree that there is something shady going on. I've been banned from DPC Fanatics for the past couple months for swearing amongst other things, while the whole entire room was swearing. Manic just strongly dislikes me, and used his personal feelings in a way that a site council member or another person of 'authority' (if you can call it that) should never do. |
People may throw some bad language out, but never at anyone or to intentionally hurt anyone like you did! |
