I always thought this would be an interesting movie to make, but don't know how it would end morally or ethically well...
Here it is:
You are a health young man, family, wife, kids, good job. While out after work with co-workers, you lose track of things. You wake up the next day in a cold bath. Kidney removed. You are the victim of organ theft. I don't want to debate where and how it happened. What's important now is that he get checked out, file the right police work etc. Physically, he's fine. However, mentally he's angry. Someone took a kidney which could cause him to lose years off his life etc.
Digging deep into the dark world of smuggling, he finds the person who took his kidney and through his own means is able to track down who received his kidney. The man who received who paid for the kidney lives in the next state. He is not rich, he is not famous. His daughter needed a transplant and was taken advantage of by the criminal surgeon "We can get you bumped on the donor list for X amount of money."
Obviously, the surgeon and his team would be locked up. The father, I don't know. The girl is alive because of the kidney.
Morally or ethically, could you ask for your kidney BACK? Legally could that be done (I'm not a doctor so I don't know what the risks to the man are but I'm sure the girl would be in whole lot of trouble health wise.) If it weren't a girl, who has no idea what's happening, and instead it were a man who KNEW that it would be a stolen organ, would that make it any different? Would laws allow you to remove the kidney to return it to the original owner and thus killing the man who paid for it?
I might be missing some details that would make it important for you to answer, so if you add a few details of your own here and there to try and answer, please do.
My answer would be: I couldn't. No matter how bad these people are, whether a girl or a man (Who knew what he was doing) I would not be able to ask for it back. I would want everyone locked up and made an example of. This is of course my answer sitting in front of a computer and not dealing with it in real life. |

I've seen documentaries about it happening in the part of the world but didn't want to make it about China. In the article, the boy who sold his kidney got himself in with the wrong people. While he should've been allowed to walk away, when those kinds of people are intent on keeping you, you risk losing more than a kidney. To stay on topic, the kidney was removed WITHOUT consent of the man and done so by means of drugging, kidnapping and removing organs. |

The victim can get by without the kidney (providing he never has an accident that destroys the other one) but he has been seriously wronged and should get a truckload of compensation. Who pays? The girl and her father can't, but the doctor has made money off this theft and should have assets seized and forfeited to the victim. Then he should go to jail for a loooong time, and then lose his license to practice medicine - forever. If the father knew what was happening then he needs to go to jail too. Probably not for so long as he had extenuating circumstances. If the recipient were a man who knew full well what was going on, then jail for him, too. In no circumstances would there be much to gain by getting the kidney back. The risk to the recipient would be extreme (they'd only survive if they could get another one) and the original owner would not be able to have it re-implanted without facing risk to himself.

False premise. I gave away a kidney in my early twenties and there is no evidence or expectation of any reduction in lifespan. Sure there would be a problem if my remaining kidney was damaged, but my heart or liver are more likely to go before that happens. ;-) |

Ummm the guy in the news story didn't consent.
He was detained against his will and he was drugged.
Which part of your hypothetical scenario isn't included in the story in the article?
