I have just read the terms of use for DPC and there is one term that says we can't depict alcohol, drugs, or cigarettes. In the rules for the Habits challenge, it says we can't depict illegal substances. Aren't cigarettes and alcohol legal? Are these subjects ok for this particular challenge?

it states twice (rules and challenge) that it's not ok.

Would that include things that "go with" those things? Cigarette cases, etc. Also. . . I have seen many pictures featuring liquor bottles, mixed drinks, crushed butts in ashtrays, etc., here on the site. ???

I'm specifically referring to cigarettes and alcohol (not illegal substances). It does not state this anywhere except in 4.2 of the terms and use. If this is the case, then the rusty nail photo by drgsoell (sorry Dave, not trying to single you out, just prove my point) should have been DQ'd but it wasn't. He even states in his description that it was made with real alcohol. I have seen other pictures in the galleries of alcohol as well. My point is that the rules for the challenge state 'illegal substances.'

And there are also plenty of photos depicting smoking and/or cigarettes. This one of the 'rules', like the (in)famous 'artwork' rule, that badly need re-writing, as in their actual application they are meaningless at the moment.

On re-reading that sounds harsh on the admins and council here, which is not what I intend. Just an obsevation of fact. There is an image of Kiwi's that still stands, but which blatantly disregards this rule.

In short: I wouldn't worry about it if I were you. But then, I've thought that before :-)

wow. i'm not sure i'm glad i read this. i guess i will leave my shot in but am really really curious about this rule which i had not read before. i recall the nudity bit because it's reiterated in the basic editing rules.

and i guess i have to ask: WHY???

here's the rule lifted off the terms of use page: "You will not use the DPChallenge.com Service to post content or to design, manufacture, market or sell a Product that...(viii) encourages or depicts the use of drugs, alcohol or cigarettes"

I think we all agree that it boils down to "encouraging". But that bumps right into what is encouraging! My husband despises smoking and drinking for the most part, but he semi-collects some really cool looking smoking and drinking accessories from the 30's and 40's. They are very cool designs, but could that be interpreted as encouraging it? Glamorizing it? But then, a lot of the cocktail shots here look very inviiting!

I'm not insulted nor upset with your comment. Since I am not much of a drinker myself I never even thought about that rule until I read this post. The only anger I feel is with myself for missing it. In fact, that might be one reason (of many) it finished lower than I expected. Thanks for pointing that out to me.

it sounds like i'm looking at voting on about 200 photos of people smoking and drinking....could someone try something a little different? please?

how about this...any shot i see of a cig or some alchy bev automatically gets a 1 from me for being trite. :)

I can only speak for myself, but I agree with the-O-ster. I am just afraid that everyone is going to take this one very literally, too, and will argue over just what defines "habit". All the ideas I came up with my family thought might get struck down due to taking the term habit a little looser. I know that I personally would rather see some great, creative shots than a snapshot that covers the "habit" part but is otherwise a poor, uninteresting shot. I think we are scaring away people's creativity. I don't want to see a bunch of dots and circles for "centered", little jar/big jar for proportions, etc. (With the exception of those of you who can make the trite and overdone POP, which a talented few can!)
