That was not clear in the OP but still, you could have answered the question before shipping the lens, that would have avoided all the trouble.

It seems to me you got plenty of opinions already and most think you are at fault (albeit without intention to scam), are you waiting for that balance to tilt the other way?

His available remedies should be of no relevance in your decision. I hope you are trying to do the right thing and not trying to figure out your chances of getting away with it

Actually that is a GREAT solution. Ebay couldn't care less how you settle the issues as long as both parties are happy.

Look, why don't your father drive to the guys house, give him his money back...all of his expenses...and pick up the lens? DONE Isn't it under $100? Cheep lesson. Get signed rec.

Before putting the item up, I WAS sure it was Ai-s. I had no reason to think I was scammed the first time around. It was when the buyer received the lens that it became Ai. Had I been asked the question earlier in the week I would have said it was an Ai-s from what I could find on Ken Rockwells site matching photo to lens. I never looked at the serial number or took a picture of it. I didn't know I had to. The lens was in prime condition and so instead of taking photos to show that their were blemishes I stated in the description box that OPTICS were PERFECT with very minimal wear on the body. With previous sales, I have used stock photos. When someone asks for a picture of the item or of the item being used I post it on my website for them to see.
I'm not looking for DPC members to validate my way of handling the situation. I'm looking for objective views on the situation. If I asked my wife "Is this my fault." She'd probably say "Buyer beware." and if the situation were reversed, so would her opinion. Here, nobody knows me very well and I can get opinions from all points of view.
Small claims court would not work. I live in Japan, he lives in Canada. Is he going to go through the process of claims court for a total of 70USD? Actually, his home address is about a 20 minute drive from my families home. He could, instead of shipping it to Japan, ship it to my families house (Or drop it off). I haven't mentioned this yet because I'm not sure how Ebay rules would apply. |

The outcome:
After making arrangements with family at home, I suggested that he drop off the lens, allow my friend to inspect it (A photographer) and have my family reimburse him his brokerage fee if he could provide the document for it.
Next email said he had a better idea. He would leave a good comment (Releasing the funds) and he would sell it. In return, I would pay for the brokerage fee via Paypal. His tone changed quite a bit. Whether he already found a buyer for lens or not, I'm not sure, but I accepted it. So game over, lesson learned. |

Maybe he checked the serial number and found out it was the right lens after all ... :-)
Glad it seems to have worked out OK for both of you. |

This has been an interesting thread, and I learned the details about Ai S Nikkors. I am happy that you got it worked out, and kept your 100% feedback without it being too expensive for you.

Glad this worked for you....I didnt read ALL the pages....so if its included in some post I'm sorry..
But other than shipping cost, why couldn't you have resolved this by the buyer returning it to you...if it arrived in the same condition as when you shipped it (with exception of the discrepency at hand)..then you could have refunded...and then simply resell it????
lesson learned....don't use the stock photo, and record serial numbers....then there is nothing to debate! |

HE COULD HAVE DONE THIS......... it was up the the buyer as to whether or not he was going to return the lens.. I guess you gotta read the entire thread... And, THE SELLER IS IN JAPAN... the buyer is in CANADA... seller has family in CANADA that's close to the buyer, so having him physically take the lens to someone, was simply an alternative..
heavyj You mean to tell me, that after all this guy did and said, he's not only going to leave you good feedback, but he's also paying you for this lens???????????? Can you please call say at this poin that he was totally trying to rip you off and when you didn't bend to his will, then he had no choice but to follow through...... I mean, WOW.... You couldn't pay me the equivelant of 30 ai-s lens' right now to believe that he just simply had a change of heart or found a buyer of this unwanted lens and has decided to move on.. I think the fact that you wanted him to actually go face to face with someone & provide proof that the lens is NOT what you say it was, was the preverbial final straw... I am so glad you stuck to your guns and didn't just fold and send him back his money... The only lesson learned here is #1, for sure keep pictures of your gear, especially when selling it.. I still think it's a great idea to use stock photos.. #2, don't doubt yourself nextime someone tries to convince you you've done something wrong... |

if you use a stock photo you should always leave a note that it is not the actual item but a stock photo somewere in there... |

When looking for items that have stock images (Because the same images appear everywhere) there is never a mention of use of stock images. However, future sales will always have at least 1 real image.
The seller had already paid me. The funds where on hold. The funds would have been released in a few days unless he opened up a claim with Paypal in which case it would be a "My word versus his." Perhaps he realized that going this route was more dangerous and decided to offer something that would lessen both our loses. I wouldn't say he tried to scam me (99 percent sure), but being rather new to ebay and having already had 3 attempts to scam me (They weren't successful thanks to DPC from a previous thread warning me) and decided to be careful.
He released the funds and trusted that I would pay him 40USD. I could have held the money and he wouldn't have had any real tangible proof that I did anything wrong. He showed trust in me so I trusted him. |
