Just been forwarded this NYPD order by a friend, makes for an interesting read:

I cannot get to the link (timeout) but I read on photo att that while it's a good step for common sense, there are still some vague wording that will let them do it in a lot of cases anyway... A good start for sure..... |

I've added a mirror of the image, which you should hopefully be able to get to. As for the order itself, yes, there is potential for officers to use their own interpretations of it, but at least it clarifies major areas (such as image deletion).

Does anyone know - I don't believe this covers the transit renta cops... I know there was some discussion with them also but this is only the NYPD. |

Man...wish I could've had this last week...the hubby went to New York last week and had people screaming at him that he couldn't take pictures...etc...he said he just told them calmly he 'would' take his picture and be out of their way quickly. He said they would just keep yelling the whole time.

I guess it all depends on where he went. I have been to New York, albeit not lately and there were locations where there were signs that explicitly forbade the taking of photographs.
As far as taking images in the streets or near recognized tourist attractions, I can't say that I have ever experienced what your husband went through... then again I do have a very innocent and rather disarming look about me... hehehehe :O)

In response to the comment about the transit rent-a-cops, the order does say that the MTA expressly permits photography and video recording in the subways, Long Island railway, and Metro-North systems.
Interesting item of note: photographers require permission from the MTA for "commercial shots and/or the use of additional equipment such as lights and tripods." I can kinda understand the lights. If you are doing any sort of elaborate lighting then chances are that you doing something commercial. But a tripod? Um...its kinda dark in subways and I really would rather get decent shots than blurry jumbles of subway-like images. That being said I had heard when I went to NYC in 2005 that no photography was allowed in the subways so I guess I should take what I can get.
Edit to add: It would kinda funny that if the MTA doesn't allow photography when um...they have a picture of the day on their home page.

The tripod issue is mostly one of them not wanting any extra obstructions in a hectic environment -- someone tripping over a leg of your tripod could easily start an "incident" ...
If it was late at night and on an empty platform, and you asked the guard nicely first, they might let you set one up.
I have a little mini-tripod I got from REI -- it has a handy Velcro strap which lets you clamp it to any available pole or railing; you could get a walker or cane and strap it to that. |
