Now, if the picture(s) in question are copyrighted by someone here, please have the owner contact me.

Let me say that again, just to make it clear: PLEASE HAVE THE OWNER CONTACT ME.

I will gladly remove any pics the copyright owner wants me to remove. Pronto! Heck, if you want, I'll post versions with the full copyright intact and provide a link to your site.

Like I said, I'm not out to rip anyone off. I'm a reasonable guy. But shouting at me and threatening legal action won't do anyone any good.

A reasonable request, on the other hand, will get instant results.

Here's the thing, Nick - every photo you take from any source is copyrighted by someone. It makes matters worse when those copyrighted photos are used without permission and/or without credit given to the original source. Your disclaimer is very very weak and is really just a way of saying you think it's easier to ask forgiveness than to ask permission. Someone's kid showed up on a porn site, and you don't expect people to be angry? C'mon...

did you ever think to contact the copyright owner and request permission in the first place?

you've put the burden of enforcement on the copyright holder, which is bass ackwards. you should be in charge of ensuring that you have the rights to post something BEFORE you do so.

Makes me wonder why people start threads like this. It just stirs up the mindless mob. From now on, the site should encourage PMs only when this situation arises, so that the individual whose content is being used can deal with it privately in whatever way they see fit. Sheesh people, what a dumb reaction, to bombard somebody with e-mail, instead of letting the actual copyright holder deal with it appropriately. Well done.

I do find it funny that on your legal page you have this

Material on this site, including, but not limited to stories, may not be reproduced in any form for profit without the written permission of the author, Nick Scipio. Any story may be freely distributed with a standard disclaimer attached.

But yet you feel its ok to use and post other peoples copyrighted items without their permission. So its do as you say not as you do? People here take copyright stuff very serious and you should as well. BTW why would anyone contact you as you say you wont pay any attention to anyone except the Originator of the photo that you stole?

Just because this guy cant create a sucessful website based on his own original content, he has to go use other peopls images to make his site popular.

Don't get mad because every month we bust a site like yours with several of our community's images.

I cant just go write a book and use other peoples images as examples, and you cant create a website and do that either. Sooner or later your busted.

agreed. i'm not thrilled about the public reaction, but i am glad we're looking out for one another.

it's one thing to joke about torches and pitchforks, but this is really shannon's battle. and parrothead's.

Hi Nick,

Thanks for posting. I wonder if you would reconsider your requirement to have the owner contact you. It's clear from your post that you know the image is not yours, it's clear from this thread that you either do know (or should know) both who the original owner is and also that the owner wants it removed... can we see some of that "instant action" you were describing as a matter of good faith?

Which one of you guys called him an A$$hole? sheesh get down!!!! haha I gotta give this Nick a little credit for coming forward and making a statement here, At least he isn't hiding under a rock somewhere. However he still should have asked for permission in the first place so his statement here is really trumped by the fact that he was the first person to jump into the mud pit. Followed by the Ever Working DPC Photo Theft Prevention and Insult TEAM. Go TEAM!!!!

I just burned a bunch of MP3's for my friends from several artists. I know its wrong but if they want me to stop doing that all Green Day and Led Zepplin have to do is email me and I will stop.

No, you were one of the more reasonable folks. But others, yes, they're overreacting.

Why am I participating? I thought Shannon asked for suggestions. If he meant only "suggestions on how I can unleash the hounds of hell" then I misunderstood.

Shannon should definitely take action. There's no question everyone should expect, others to respect their copyrights. And the site's nose-thumbing "disclaimer" is just silly, because of course he knows he's posting someone else's pic.

My suggestions were about the nature of the response, not whether to respond.

I agree. Better to just notify the photo owner.

BTW, I'm looking at the site now. The photo as done by scalvert isn't offensive, but rather innocent, in my opinion. Its more like he walked in on them and probably wouldn't have seen much at all. But the fact that its on a site that child predetators probably frequent is very disturbing, and irresponsible on the part of Nick the site owner. It also doesn't take much effort to ask permission, but I suspect that Nick didn't expect to get it.

BTW Nick, Do you know for certain how old the girls (or guys) are in the porn photos you've acquired?

I sent Nick a stern note, but I don't think he has the slightest clue how much trouble he invites with his "opt-out" copyright infringement.

Please keep it civil, folks. There's no reason to take matters into your own hands or suggest other illegal activities in retaliation.

I have the "owner contact" requirement for situations like this. I really don't need more trolls and busybodies in my life (do any of us?). So I don't accept third-party take-down requests. It's simply a matter of ownership. If the owner of a copyrighted pic wants me to remove it, the picture will be gone within minutes. Otherwise, I'd have every Tom, Dick, and Harriet contacting me any time they simply objected to my caption, didn't like my politics, or... whatever.

I'm not trying to hide behind a third-party statement here. I'm very easy to contact. I don't want to damage anyone's reputation, livelihood, or good karma.

As for a "good faith" removal... sure. Give me a few minutes and then check the pic. (Warning, the replacement pic is definitely NSFW. It's also a subtle dig at all the hoopla... in other words, would you all the trolls please climb out of my ass and relax?)
