That is just plain and simpley OUT OF ORDER!!!! I had some a$$hole abusing pics of my daughter from this site once but thank god it seems to of stopped... he was posting them on yahoo.. using IP trace i managed to find his server and notified the server of what he was doing.. I hope he got thrown in jail for what he done. I know how Shannon feels having his kid on a perv site....

The site owner even admits that IF THE IMAGE IS YOURS LET ME KNOW AND I WILL REMOVE IT PROMPTLY.. no 3rd party requests... HA!

he's got his own nameservers, and an anonymous domain registrar. how would you find out who his hosting company is?

has anyone PM'd scalvert about this? I'm assuming that since the image is still there and he "says" he will remove an image if asked by the owner, that either he is lying or scalvert hasn't contacted them yet.

Its only been 2 hours even if you PM'd em already he probly hasnt gotten it yet, thats all. Also once scalvert emails the guy how often is the guy on. He might remove it when asked but lets say he only checks his email every couple days it could take time.

That's a polite way of saying the owner has to prove (to Nick's satisfaction) that they are the owner before he will do anything but ignore them. Fastest and easiest way would be to go thru the hosting company. A traceroute to find the upstream providers and sending messages to them as well wouldn't hurt anything.

It doesn't matter who the copyright holder is, this Nick guy knows it's not him, so it should be enough for the hosting company to take action. But it does need to be Scalvert that does the emailing. :)

BTW: while we're damning this Nick-guy, does anyone know if Scalvert has the image is on a stock site anywhere?

The person simply removing an image that they have violated copyright is NOT adequate to relieve them from the liability from the infringement. The damage has been done, so Shannon has a good case for infringement.If anything the statement shows that the site owner KNOWS he's not using the images legally. If I were Shannon, I'd be pissed off enough to go after him legal guns blazin' so to speak.

I didn't bother to go look at the site... I've got my own little ones underfoot. But, it seems to me that someone who goes through the effort to alter photos and put a note on his site to notify him if you see your photo there probably already knows about any photo site that he could download photos from. Its not all that difficult to find DPC. I'm sure he already knows about it. If a buddy of his altered the photo, then his buddy already knows of DPC.

Either way, the image was stolen (and probably other images on his site); and, the guy with the website knows he has stolen images on his site.
