I'll try and make this really short but I hold no promises...
Last week I was surfing eBay and decided to get a few new Extreme III SanDisk cards, I lost a few auctions trying to get hold of a 4Gb CF Card so decided to Buy It Now on someones page. The item turns up and I decided to give it a test, instead of it taking about 23 - 26 seconds to write a series of 22 RAW Files it took 2 mins 25 Seconds. Soooooo I then give it 3 tests in SiSoft Sandra Professional benchmarking tool and it failled one out of the 3 tests. When it did work in the other two it reported an average of a 6X speed card.
Next I decided to get back onto the seller and ask about how to return to get a refund to notice this seller ( had done hunderds before ) had left or been suspended from eBay. I did receive a mail from him and as suspected playing down the fact that I had got a fraudulent product.
Heres where I will cut the story short, after 5 emails this week and me standing my ground stating I was prepared to lose the money I had paid him as I should get refunded it by eBay / Paypal and if not then my credit card company will pay up, he has now agreed to give me a full refund (which has just been processed through paypal), probably due to the fact of me saying that I would contact the authorities about dealing in fake goods and also go to trading standards.
Heres the dilemma
A) Do I now send the card back to him and leave everything as it was.
B) Do I give the card to someone who does not nee dthe write speed
C) Do I get onto trading standards so that he cannot screw over other people too?
What should I do?
P.S. I also had him pay me what he charged on eBay for delivery as the envelope stated £1.68 and he chraged me £5 so even if I do decide to send the card back I will be £3.32 better off :0)

Firstly, good on you for following this up. So many people shrug off this kind of thing (which I do understand - the time investment in chasing up is worth more than the product itself) that these people continue to get away with it.
Whether or not he refunded you in the end doesnt change the fact that he misrepresented what he was selling in the first place.
For that reason I would, if you have his real name and address details, report him to any relevant trading standards groups you can.
On the other hand, he was perfectly entitled to charge what he did for postage. You knew about the postage charge in advance and accepted it. You must bear in mind that the charge covers both postage AND packing plus can take into account time spent on packaging and posting. Whilst adding $3.32 over the postage cost itself seems a touch high its not unreasonable, in my opinion.
By the way, I know there are no apostrophes in my entire post - I often have this problem where the apostrophe key seems to somehow remap itself to the Browser Find feature and it doesnt reset until I reboot. I keep forgetting as Im typing (just did it again) and its very frustrating!!!!!

Yeah sorry the postage thing ddn't bother me as I have added more to cover the cost before when selling, I was most amused that I had the balls to state ful refund plus £5 for the postage back... I think I will be going to route B&C and will then send him his £5 back so that I am not taking the micky...

Personally I would do B and C and I’d take the micky â€Â¦ The seller has wasted your time and £5 is not a lot to cover that most precious of commodities. |

Thsi crossed my mind and I think I will be going down this route. The only one thing that is niggling away at me is that he has my address?

Pretend you are the next potential buyer of one of the fake Sandisk cards that seller will try to rook. What do you think that person would want you to do?

Hmmm, I can see your concern, but then again I think it very unlikely that he would do anything nasty. The one thing about most con artists is that they are lazy. They want everything for zero effort, that̢۪s why they are con artists :-( |

Exactly, and if the buyer before you had taken some appropriate action, you might not be here debating your next move now! |

This reminds me of an infamous (yet hilarious) eBay scam. It is a long read - but if you have nothing to do for 30 minutes or so, I know you will get a kick out of it.

I work for the Trade Marks Registry in the UK, so I have another angle here, and that is this guy is ripping off Sandisk as well.
Ask yourself why you opted for the Sandisk cards? Because they are a big, well known company who produce a very good product.
Some people think that Intellectual Property infringment is a victimless crime, I guess most people have been tempted by a copy of the latest movie, piece of software or new designer handbag that is obviously hooky. The trouble is that the people producing these goods are very often linked to organised crime.
Also, you have been ripped off but had the knowlege to recognise the cards as fake, but if you were just some joe shmoe who had no clue about fast cards or reliable cards, you could be thinking, hang on, this Sandisk company are a lot of old cobblers.
If it were me I would be onto Trading Standards, this guy has only been co-operative and helpfull because you have caught him out, if you hadn't realised, he would be rubbing his hands together and waiting for the next victim to come along!
