Ok, We have some clarification. I'll post this in both threads.
The images should have been DQed under the Nudity rule which states "Nudity is an acceptable form of art on this site. Photographs may not, however, show male or female genitalia or any acts of sex." Refering to the part about 'acts of sex' and masterbation being an 'act of sex'.
I have revised the DQ reasons appropriately, although they aren't publicly viewable.
On that note, the images in question will be allowed to stand in the users portfolios because the challenge rules do not apply to portfolio images.
Sorry for the confusion.

Whew! For a while there, I was afraid both of them would ribbon. Not sure I could have stayed away from -- er... make that continued to visit DPC while they were on the home page. Scary thought.

You have the option to hide photos containing nudity from your preferences page. Those images will not show up then after voting is over.

actually... i dont understand the DQ. were they too close to the edge in a contest that includes "lust" as one of it's topics? there wasn't anything in them that i found offensive or disgusting.

i think that DQing these pics is ridiculous.

Not that I really want to join the debate, but ... I don't thing the two DQ'd images showed the "actual act" any more than the above image. They both alluded to (a lewded to?) what was going on without actually showing anything.

Anyway, I thought the images were funny... especially when I ran across the second one and realized what they were doing. Very creative "team work" IMO.

A couple comments from me:

DQ??? Talk about inconsistency! I only saw his in the challenge and thought it funny, but maybe distasteful, but not DQ offensive - and not nearly as offensive as many I've seen in the past that seem to violate the ToS. You're just asking for someone to pull up many other photos (like buzz's) to compare and contrast and ask WHY.

Regarding the Hide Nudes - that is a pointless safeguard. It relies on the individual to flag the photo as nude AND it only hides thumbs in certain pages - it doesn't hide buzz's posted above. Go ahead and check the box in your prefs and then view the Nude III challenge archive - most of the thumbs are hidden, some are not, but you can click on ANY of them and see the full images. Everyone has their own tolerance and opinions about what they or their children should see and I wouldn't have it any other way - just should be clear that the site is not as "child safe" as people might think it is.

That's all I've got - except for the additional disappointment in the inconsistent application of the rules.

I tried it and you are right. What is the use in hiding them if they show up anyway.

The rules as I've read them clearly say that sexual organs in the "act of sex" is not allowed. Fotoman's photo clearly shows that and this photo doesn't. Not only are the private parts not shown, the bodies aren't even aligned correctly so the viewer doesn't even come to the conclusion that the two are having intercourse. Unless fotoman's photo was an attempt to show jock itch, his intent was to clearly show masterbation which is an act of sex. This seems pretty cut and dry to me. It is the "moment" of sex if it's captured explicity (i.e. showing it) is not allowed at least according to the current rules. To hint at it is allowed which is why this photo wasn't DQ, IMO.

Just for the record, it wouldn't bother me if this part of the rules was removed but since we have them currently they should be enforced.

How about having some sort of password protected section for those of us who would like to see MORE of this? Sounds like a challenge that includes "sin" should have been in there.

That way it would be easy for others to stay away from it if they don't want to see it (or don't want their kids to see it).

Make it secure, then let us loose *g*

Also, in the currently in progress rules rewrite, could we have the wording more clearly define the differences (whatever they may be) between intimatacy that could remove a person from a challenge and intimacy that could remove a person from the site.

It seems like another very slippery slope the SC have created for their winter games pleasure! Just don't try to stabilize the board on the last jump. :D
