I don't know if you notice, but they're offering it for print on Shutterfly, only wallet size because of the 640 size. Credit or not, who gets the proceeds from that? Click the Shutterfly link above the photo. Congrats on the unintentional first place though! |

Ahh... now there's the rub!
Let me see if I got this straight -- one of their webmasters, Sonja, takes images from dpc (and presumeably other photo sites), puts them into a weekly contest, and sells prints of them thru shutterfly? All without permission from the photographer who owns them?
I would expect shutterfly to end that practice if they were aware of it. But then Somja will probably just find another printer.

And because the photo that she took had a lower resolution, the prints that people get will not be very good quality, which doesn't reflect on sonya, it reflects on the photographer.

I seem to recall that selling prints through Shutterfly is a function of the gallery software that they are using. I'm guessing that whoever set it up just didn't turn off this function. Which isn't to say it's okay, but I bet that's why that feature is there, rather than an intent to profit off others' photos. |

Ack, I didn't notice the shutterfly link until you pointed it out. I will send an email to Sonja telling her that the use of the image is not authorized and could she remove it immediately. I'll also mention copyright laws and ask what her site readership is.
(heheee, shot isn't copyrighted, but I didn't actually say it was :P)
Could be an ugly lawsuit if I'd get off my duff and apply for copyrights. :)

Btw... I checked the image size on the other 2 sites that hold this image. It was definitely taken from here, the other images sizes are different.

The copyright is inherent in the work itself, unless done for another. |

The gallery software has an option where you can allow printing through 5 different companies, Shutterfly included. However, I'm not sure it allows for 'selling', as in a DPCPrints sense. I think that function just uploads the file to shutterfly so you can have it printed at shutterfly's normal prices (i.e. shutterfly is the only one profiting). I think the idea is so that if your using your gallery site for family photos you can allow relatives to order themselves prints or something. I haven't activated it on my own gallery site, but that's the understanding I get from my boyfriend/webmaster.
Regardless, Sonja or whoever this is shouldn't just be pulling people's photos off DPC for use on her own site, even if she is giving credit...

I think there is an intent to profit from another person's work merely in posting other people's photos on that site, with or without the sale of prints thru shutterfly. Very hard for me to dismiss that as an innocent mistake even if the link to shutterfly is. And that's a big if to my way of thinking. Receiving income for the print sales from shutterfly should have alerted them to that mistake, assuming some sales.
After reading kearock's post: Even if that site is not making any money off the sale of prints, just letting them go for shutterfly's base price, it's still not there business to decide where and for how much idnic's shot sells. She may be trying to sell it for more, perhaps at DPCPrints.

how my image 'Will' got there. I am certainly going to try to find out though.
I appreciate you bringing this to my attention. If someone is ripping off my
photos, I want to find out about it.
Well better tell Amy as well! Let me know if you hear anything back from them. I have another source who might know something...I will check with her.

Send them an invoice based on this number and the use on a web-site. Obviously the fee will be partly based on the illegal use of the image. |

I threatened as much in my email. Also told her she needed to send me a report of sales (if any) of my image.
