If I take a photo of my buddies Diablo, I get permission or a Product Release from him right?

If I take his Diablo to a great location, remove the number plates or other identifyable items so I have a generic Diablo, and take a pro looking photograph, Do I have to get permission from Lamborghini to use the pic?

Note that this is not for newsworthy journalistic stuff.

I've wondered the same (though never got my hands on such a fancy car)

I've never been able to get a straight answer, if I photograph my own car can I sell prints of it, put it on t-shirts etc or do I have to get permission from "Land Rover"

And even if the logo is not clearly presented, does the unique bodywork signify trademark?

Some car companies do have the shape/style under copyright. Usually it is the more expensive ones. Contact the company if you are unsure. My guess is you can't sell pictures of this car unless you get permission from the company, no matter if you take the logo off or not. It's the car design itself that is protected. This is only a guess however and it is better to contact the company.

Could you post the photo in question? Actually I just want to see the car! Better yet, could I DRIVE the car while I ponder your conundrum? Driving fast always helps me think clearly! :-)

When I was just out of the army I had a job as the "house detective" in a fancy hotel (glorified security guard.) One of the duties was to park cars for very late arrivals; after the valets left for the evening. I was hanging out at the front desk one night when a guest checked in and he put Countach on his check-in card for his car. I thought I had it made, but he had a friend take it to his friend's parent's house.

I had a pretty good deal for shooting pictures of luxury cars though. The hotel's parking garage had been expanded by tearing out walls into old office spaces around it, so there were rooms with relatively clean floors where the valets would park the best cars. I took almost all of my best car pictures in that parking garage.

Hehe. Car(s) will be shot next weekend.

Client makes calenders and is willing to pay me money (around 40 usd for single use per photo for a year)single of course meaning single line of calenders, all my pics will have my name on) for various things wildlife, lowers fruit, fast cars, dogs, racing cars/bikes etc.
The racing cars/bikes, I'll approach the driver/racer after the track meet and ask for a release.

With the (generic)modern and classic sports cars, I need to know if I can do it permission free, with permission, or if without permission, if I can do photorealistic 3D renderings and get away with calling it art, or skipping to etc.

ps. There is no big budget to pay Italian car makers royalties.

Seems to me the copyright problem lies with the publisher, not the photographer.

Yes Bear, of course it is. But I will have costs and I will have other uses for the pics.

And besides, this is sure to pop up in Trivial Persuit one day :0)

I agree with pcody - I'd be highly surprised if Lamborghini did not prohibit the sale of images featuring its design without its permission, plates or not.

There is alist somewhere on the web, but porsche and lamborghini are no no's. I believe the shape of the car is trademarked.
