Judging by the skid marks, no left-turn sign, and positioning of the cars, I would conclude that the blue-shirted driver is clearly at fault. Probably also has a alcohol blood-level of 1.3 as well. :)

The "title" of the picture is 50% of picture in this challenge (in my opinion), and I can't believe the TERRIBLE titles I've seen on great pictures!! :) You should have used "The Most Unpopular Stop Sign in the USA". Or "Residents Petition to Have Stop Sign Removed". You'd get a 10 with a good title, but a 7 with this title. Very nice picture, BTW. :)

Nice idea but the composition is irratting. Could you have moved to the right about 5 feet and taken the pic? That would have put the Sign on the left, the Church in the middle, and that nice Tree on the right. Might have been better. As it is, the tree and sign are fighting for attention. 5.
