Just my opinion: In using the portrait orientation, I would have cropped this so the mask was perfectly vertical and split right down the middle.
As far as backlighting is concerned: Yes it is lit from behind. In a classic backlighting picture, there are shadows in the foreground to contrast with the light. This doesn't depict that.

The lighting is great on this photo, but the subject is something else. Not because it is santa, but because it is a nick-nack and therefor uninteresting to me. However, I'll bet if this photo was used to sell this santa statue on e-bay, you'd get more than your asking price!
