I had to share because it just makes me chuckle. Who knew lawyers had a sense of humor...

This is how you respond to a cease and desist letter

I really enjoyed the "serious" part of the response where all the stupid was exposed. :)

if a lawyer can get disbarred for making a baseless threat on the basis of intimidation, why arent these lawyers reported more often.

Because this sort of stuff only gets you reprimands and MAYBE a practice restriction like "you are an estates lawyer, stop trying to practice criminal law". You only get disbarred when you misappropriate trust funds.

I'm thinking of saving it so I can re-use those citations.

However, it's a good thing Mr. Kaplitt agreed to work pro bono or that letter might've cost $28.763.22 ... :-)

Any lawyer who can use the work "kajillion" in a response letter is my kind of mouthpiece.

Lawyers who want to misappropriate funds work at banks that are "too big to fail".

Terribly sad news indeed. Terribly sad.

Apparently a bus of lawyers headed to a conference went off a cliff in California today, and one lived.

Things aren't always cut and dry. Been on the receiving end of ludicrous correspondences before,
and written some letters(not to this extent) that later, when the facts came to light, cringed and perhaps laughed a bit.

off topic, but, I do recall that, one time, included in special defenses to a vehicle vs. pedestrian case, finding the elusive "bagel defense."

Atty for co-defendant tortfeasor who was accused of knocking a plaintiff down while driving away from a daytime fight in the projects, indicated in her special defenses that(it was excusable) she feared for her safety and "could not drive the car properly, and that the plaintiff was responsible for her own injuries because the plaintiff threw a bag of bagels at the defendant." That was a great special defense.

Ha! I was reading that one too! I'm definitely keeping that one in my pocket for the next inane email I get at work.

That's about right. Real disciplinary action is typically isolated to acts of dishonesty, fraud, theft, etc. Screwing up the law, etc. isn't. Folks make mistakes, including lawyers.

And may folks, including lawyers still think domain names constitute intellectual property. Unless you work on IP matters all the time, it's easy to see how you might believe that. And the lawyer who wrote the demand is essentially a business/municipal lawyer.

That's a pretty funny response, but I still like this one the best.
