 Picoides pubescens

The head is turned to the side but it's the clearest shot I have of that angle - and shows the red spot well.

(I chose Downy vs Hairy based on the shorter size of the beak and the presence of the black spots on the outer white tail feathers - more visible in another shot)

Good identification. The criteria you listed are the correct ones to differentiate from Hairy WP.
