Originally posted by DrAchoo: Just to update people. We finally have resolution today almost three months later. I knew it would take a while and it is important in situations like this to be patient, but an agreement was reached by both sides and I have licensed the photo of Laine to the childcare company to be used for their advertising.
Now the next step (which may take even longer), is to talk to the company that offered them the photo in the first place. We shall see how that goes... |
Congrats, and well done for seeing it though in the proper manner.
I would think that the childcare company will already be chasing the people who originally supplied the photo as well as they will have paid for it already! |

Congratulations
I drove past the sign yesterday and was wondering how you were getting on.
Is the company who offered the picture an Australian company? |

I anticipate it is, but there are a few companies listed on the webpage, so I need to hear which it is from the owners of Kids in Care.
CO, everything you said is true, but that doesn't mean I don't have business with the company. They stole my image and sold it as their own (or one they had the rights to). Regardless of the fact that Kids in Care now has a license with me for the image, the web design company still owes me restitution for a) infringing on my work and b) using my daughter's image for commercial purposes without a release. |

Completely agree, I was just pointing out that you won't be the only one after them over the issue, and they deserve everything they get! |

Oh, sorry! Ya, it's possible the childcare company has already gone after them. I would have... |

Hmm, well, I made contact with the web design company. They claim the picture came from this link:
//www.qalereya.com/displayimage.php?album=65&pos=63
I only get a godaddy.com site when I try to pull that up. Could it lead to something different if you are somewhere else in the world? |

I played around with that web address because as I read it, it is saying to go to album 64 and more specifically image 63 on the 'page'
just typing erasing all except //www.galereya.com takes you to the godaddy site. Which means
a)the site does not exist
b)did exist when they got it but does not now.
If they *got* it from this site would they not have made contact to get permission to use it. They should have more information to give you - as it 'appears' now they just sound to me like they are giving you the run around. |

I didn't even think of entering it in as a search on google!!!
Yup looks like it is exactly that but I won't even venture to click on any of the suggested links.

Final update on this. I have come to an agreement with the web design company and the whole affair is behind us. Thanks for everybody's support. The proceeds will go toward a vacation to Disneyland for the kids, so Laine seems to be receiving payment for her model work. :)
