While I don't think it's right for a company to use an image in this way without permission, and that the good Dr. should have all legal means available to him to get this company to STOP using this image (or start monetarily compensating him for using it FROM THIS POINT FORWARD, with perhaps a reasonable payment for prior usage), I personally think that all this 'excitement' by people over "OMG PAYDAY!" and such is a bit ridiculous. DrAchoo certainly wasn't losing revenue or profit by the use of this image, so I don't really believe he's entitled to ANYthing, unless they continue to use it after a notification, or he can somehow prove that its use resulted in a loss of income or livelihood.

This "get rich quick" mentality has to stop. It's one of the reasons that copyright law and the DMCA and patent corruption is so goddamn broken these days.

The real issue here is the flagrant use of an image of a minor without the permission of the parents.

Any court should take a pretty dim view of that especially from a company who specializes in child care.

Somewhere along the line, the administration for that company should have ensured that their "Poster Child" was in fact, an authorized kid.

It's quite realistic to entertain the possibility of serious monetary punitive damages.

Agreed. What faith are parents likely to have in an organisation that doesn't lay importance on the rights privacy and, potentially, the safety of children.

If they force him to go that route, they will end up paying his legal expenses. Pretty much guaranteed.

HiFi or Lentil, does this strike you as a new campaign? Have you driven by the same place every day and just noticed the signs? Are the daycare centers new? I found a couple news articles from back in April that talked about a very large daycare company going under and Kids in Care being among the companies that was taking over some sites. I'm curious as to whether that has just happened and these signs have only been up for a week or less.

A very large day care company has had some trouble and I do remember seeing in the news that a specific Day Care Group will be picking up the slack. The fiasco has been going on for sometime...I think it has been in trouble over the last 12 months. So my own knowledge tells me that these signs could have been in use back then in their advertising....or they could be a new campaign. Hopefully the NSW girls can fill you in a bit more.

The ABC centres were the ones that were in trouble. I think the one in Baulkham Hills pictured earlier in this thread used to be an ABC and is now owned by this other lot, Early Learning Centre.

From the website which also displays the photo, Early Learning Centre is a Queensland based company, not NSW, my guess would be that they bought up a lot of the ABC places and changed the branding to match their own, however I have no idea if the branding they are using now is new.

I'd bet these guys would be willing to help put you up on a Australian Holiday. They might even spring for a new body and lens if you'd bring the family and do a paid shoot for them. Could be lots of fun. Maybe even sport a DPC meetup with all the NSW gals... and guys. LOL

Yes this one was an ABC Learning Centre.

I drove past this site about two weeks ago and didn't notice the new signage, the first time I noticed it was on Friday afternoon. The first thing I saw was the sandwich board they had out on the corner of the street the centre is in. I immediately recognised the photo because I have always been very impressed with this image.

The really fun thing about the whole situation and the reason I was in this street in the first place was because I was on the way to the chemist to pick up medicines after being to a specialist in DrAchoo's field of expertise.

I hope that the good Dr. can get a resolution that is satisfactory to him.

Hmm, been a while since I've done an international phone call. Trying to figure out what I'm doing wrong.

011-61-07-5585-4901 Would Brisbane city code be "07" or just "7"?

Figured it out. Was just a 7. But no answer. It's not a holiday or anything out there is it?

They are on daylight savings time so it is 9.12am there now - they should be answering their phones by now though.

This site may give you further information about the ABC learning centres that went bust.

Err...Sneezy is trying to work out how to use the phone....and Hifi is hiding behind the lunch tray at the Kiddie Center....the rest of us are stuffing our faces with popcorn waiting for the fireworks!!!

Could one say that this all stems from the fact that DPC doesn't watermark images? I'm just sayin'...

Actually, I was kind of surprised that you can just right click and save an image. They should at least turn off that capability.
