I'd think using a photo of a minor without any permission would be kind of a big deal?

Good point, Paul. Or it's even possible they thought they purchased it legally somewhere. You can be sure I will be professional when I contact them.

HiFi or Lentil, how big is this place? Are we talking a legitimate business or is this more a mom opening a daycare in her house?

Basically, they've got a LOT invested in that image; I'd say Doc has 'em by the short hairs and he's about to be able to afford his new body after all :-)

I donât know Doc, I think the first thing they will do no matter what part they had in the image theft is contact a lawyer.
Your best bet is have a lawyer handle it.
But if you are going to be a âdo it yourselferâ again, you should have a lawyerâs name handy. Edit after Roberts post..

OK, I always like to be armed with info before I make a move. Judi, do you have any links for a quick rundown of copyright infringement in Australia? Do I need to register my image for lawyer's fees to be included in the settlement? etc? Hey Paul, does Nolo press have an Australia version? :)

A simple heads-up inquiry may be all that's needed; they may be perfectly willing to work with Doc to make this right. It may very well be their designer that is at fault, or it may even be that the image was stolen by someone who posted it to microstock and the designer may actually have purchased the image unaware that it was stolen at all. If they are willing to license the image for a reasonable amount, why waste bux on paying a lawyer?

The legal option, IMO, comes into play if they refuse to cooperate.

I did a couple of Tin Eye searches, first on Dr Achoo's original photo as posted to DPC - 0, then on the image on the website Bear linked to - 14!

Using tineye I got 14 hits using the Doc's DPChallenge photo. You have to open the photo page, then right-click to get the actual url for the photo - not the url of the DPChallenge page that it's displayed on.

They are listed on the Australian Stock Exchange - no mum & dad operation

I would suggest get as much evidence as you can before you go doing anything. That way even if they rip the photo off their website, you still have the proof that they did use it. Whilst that Daycare is not advertised out my way, you can get other DPCérs to photograph billboards, posters, signage and such around the areas that they do advertise so you can get proof of the extent of their usage. Then contact a lawyer.

If you start contacting them, they will see that you aren't even in the country and will attempt to remove the website usage first.

Do your homework as to who might have this image on their books for stock and then build from there.

All good ideas. I have a screenshot of the website and a pic of the sandwich board now. Does anybody want to do me the favor of walking in and checking out any brochures and whether they have any?

When you go up close to the billboard, it is very obvious that they do not have the original which would help your case in proving that the image was stolen.

Australian is a criminally born version of English - its pretty much the same, just with a REALLY annoying accent.

Doc has an easier argument. He is the person that would need to sign the model release for his own daughter...

The other company that stole the image does not have that and will have a big issue trying to get it....
