Hi All....
wonder if anyone can help....
If someone makes a picture VERY SIMILAR to mine - is that breach of copyright? or is that just flattery?
Only the concept is the same - models are different - clothes are different but the concept is the same.
?

Tough call. If it were a unique composition, I would think so. It would have to be proven in court however. It's certainly a fine line to walk, and someone would have to see the two works. Are they making money from your idea? Is it worth your trouble to pursue it?
Keep in mind how much duplication of previous ideas goes on within DPC.

And we even have challenges where we are supposed to duplicate ribbon winning photos. |

with all of the copies of American Gothic (with different models), I have a feeling it isn't breach of copyright... |

And as Yo says -I think too that money needs to be made...... to prove the loss?

Under the brasilian law the idea itself would not be protected by copyrights, and I think the legal system is quite the same...
And even if people catch your work on the internet (with some copy-paste), and the site has no disclaimer about copying, it will be possible to use your work with non comercial intends. So the ¨money making¨ thing would concern if your own work is used... but if just the idea was ¨stolen¨ or ¨re-used¨ i think you will just have to be glad that you had a good idea!

The short answer is... you own your individual images, not your ideas. The reasoning is that anyone on the planet may have had a simalar idea before you did, or after you did and you cannot take action against another for having had the same thoughts. Only your images belong to you unless you obtain specific copyright protection for an "idea"; which will be very tough to obtain.
