I have a friend that 'borrowed' (his terms) a photo off of flickr..... is this a free site??? doesn't he have to buy from the photographer....

I'm giving him alot of flack but I can't see where it asks for downloads, etc.

do i still give him flack about stealing it? he's using it on myspace

No matter WHERE you find an image you like, if you don't get permission to use it, you're stealing it. Posting an image to Flikr (or DPC for that matter) does not make it a free-for-all image.

Its stealing. He doesn't have to necessarily buy the photo but he should at least ask for permission to use it. He should also give credit. Flickr is a photo sharing site. i.e. I post a picture for others to see not to use.

Thank you.....That is EXACTLY what I was telling him......and just to prove it to him, I 'found' the picture he stole....

I was only double checking as while I was 'searching' for my proof, I was finding 'royalty free' sites and thought maybe that was the same thing....

When you upload a photo onto Flickr, you can choose to give people the right to be able to use your photographs. If you use the search engine, you can select "creative commons" photos. In this case, if you follow the rules, you are allowed to use those photographs.

I think the default creative commons license allows for non-commercial use. (I'm not 100% sure of it, though.) I have received a few courtesy messages from people asking if they could use one of my shots as an illustration in a lecture or on a web site. If I were a pro trying to make money, I might feel different, but in my case, I take it as a compliment.

He was wrong in taking the photo without asking, but we also get many images posted to stumble upon. The people who post images from dp have hardly, if ever, asked if they could post it. Does the image default to the photographers flickr page? If so, then the person is just posting an image link. That should be okay, as long as the link leads back to the original page it was taken from. If, however, it is being used on an individuals page, without comment as to where it came from or with the intention of making people think it was his own image, that is way wrong. Unfortunately there is not much we can do. Sure we could contact the person, tell them to remove the image and hope they do, but it isn't like we will sick the cops on him or anything.
