I just got my new Nikon and 3 days after shooting about 400 pictures I noticed that the most recent shots have the same name as the first 100 shots I took. The camera is duplicating the file names as if I have not taken the picture. So now I have 2 or 3 of each name from 001 to 090, after that it's back up to DCS_600+.

Has anyone else had this problem or know why it's doing this?

I don't use Nikon so don't have the exact answer for you ... but on the Canon cameras, there is a setting that tells the camera whether it should number images continously or whether it should reset back to 1 each time you put a new card in. Nikon probably has the same thing. So when you recently put a new card in, it started over.

I start out by keep my pictures in separate folders named by the date that I took them. Sometimes these will get moved, according to specific groupings (family groups, etc). But this starts out by keeping like named photos from colliding with each other.

I had a similar problem when my Fuji S3 crashed and had to be repaired. I bought a second S3, and so when the first one returned, the file numbers overlapped from one camera to the other. It gave me fits when trying to do my normal 2 week and monthly backups. The computer would not let me put files with the same name and different content into one larger file, although iPhoto would allow me to have them in the same "album".
I am almost certain that you can set the Nikon so that the file count will increment continuous instead of resetting. The setting may be on camera, but most likely is in the software in the computer that you use to upload from the camera.
Meanwhile, I solved my problem by breaking my monthly backup into several sub files per month, and spreading the image files among them.
Someone here will have the exact fix for your numbering problem.

Joe, I don't have a 40, but my D200 has a menu setting that covers this. It comes default to use the same 0001 starting number each time you insert a formated or empty card. The setting can be changed to be sequential. Read your manual for further information.
