As some of you may have noticed, several threads are putting together music videos, either figuratively or literally, by matching pictures found here on DPC to lyrics of a song. It was pointed out that the folks doing so probably need "permission" from the photogs to use their pictures in this manner.
Rather than having whoever puts together the video have to PM each photog, those of us willing to have our photos used this way could put a disclaimer on our profile page so indicating. I like the videos - it's a creative way to display some of the very fine work that's here. If you like 'em too, a simple note on your profile page would work nicely, I think. |

I have added it to my page...but please make sure they are not distributed or sold as some of my images on here have been sold exclusively. I can display them but not sell them.

I've added a "use as you like" thing for members too. In principle this is a fine idea, so DPC users don't have to worry about alternate uses of others' photography within DPC. I think it might be cumbersome for some though (unless a checkbox of some kind is added to the user preferences page). A complementary suggestion might also be for those who start such threads to say "don't video-ize this thread", or "only post your own images because this might turn into a movie," or "at the end a movie can only be made if all photographers agree by posting." Or something. |

Edit: FWIW, I think both fall under fair use... but I could be mistaken.

Depending on what you want to use we can recreate a beat or instruments. And Parody's are legal also!

I think as long as the music isn't used for profit and isn't taking profit from them, the RIAA should be fine with it. I know when we made videos where I worked for special occasions, we once checked with someone about using music, and that's pretty much what we were told - no profit, no problem. |

Yeah, I thought of problems like that too, but only for a microsecond. :) I think what Deb says is right. I can't see Bowie's counsel, for example, trundling out the machinery of copyright law in order to pound a little video into oblivion that isn't making anyone any money and that might be viewed by a few dozen people. I could be wrong.

Heh to do somethign as simple as play music in a donut shop you have to pay royalties. Their trying to prevent shops from having radios but so far i think thats still safe grounds? But you can't play CD's for the customers. Most businesses just use Muzak its a satelite service thats been in business a long time, most Fast food and other resteraunts even our dealership uses. We pay them a service fee and they pay the RIAA...
On that note how does karoke service work? I never understood the doublsided rules that govern music.... |

Most bars pay dues to ASCAP to cover royalties of songs that might be played by bands. I think that the CD's bought by the VJ's cover karaoke use.
But, what's good for the goose is good for the gander. The copyright issues are the same for the music as are the photos. They both either fall under fair use or they both don't.
Only in this case, there is a little guy to get upset about it and write nasty PMs.
So, I think that for these threads we should just post our own photos to cause the video creators less grief.

On a happier note, I've heard back from most people I've had to PM, and every one has been more than happy to have their pictures used like this. And uber-polite as well. :) |
