terje posted this - I thought it warranted a new thread.

Nightmare...

My initial response:

Your images won't lose copyright because they are hosted on Bayimg. The problem is that Bayimg will not respect your copyright and will not remove your image from their server if you ask them to (unless, it appears, you were the uploader or the image is "illegal").

If your images are hosted on Bayimg and downloaded by a third party in a jurisdiction that respects copyright, you can still pursue that person for breach of copyright.

This is not to say that Bayimg won't be a thorn in the side of image owners - the fundamental difficulty will remain that Bayimg will be hosting and making available imagery to people on the internet. If hosted on Bayimg, you will not be able to take action against one person (the hosting site) and be done with it. Instead, you will have to take action against every person who uses the image in an infringing manner.

Different country, different copyright laws. I guess they aren't as strict over where they are. Visit //www.thepiratebay.org and see all the stuff they have going on there. Multiple companies have tried to sue them but can't because of the local laws.

Wow, that's pretty sad ... too bad something can't be done about it ..
