Picture it... I have some candids that may go into a book. Due to the fact that they are candids, I don't know these people and I probably can't hunt them down to get releases.
The question is - will a publisher accept photos with people in them if there are no releases? Even if they are obviously candid? Anyone know?

i think you can, there was a case about street photography and publishing photos and I'm pretty sure it is allowed without consent.

OK... this is how I understand it. As long as the images aren't being used to sell goods or services, you are in the clear. Within the book they will be considered editorial, and not need a release.
However, those photos can not be used to sell the book, such as ads for it.

evry country have his laws. here you can sell the photos if:
1) the peoples are in a public place and they are in the place.
2) you can't crop the photo for obtain a portrait
3) you can't show the photos if the people are in some bad attitude or position(i.e. nude or some particular act)
4) If the people are public people i.e (major, politics...) you can show and sell the photo's without permission but not if the point number 3 is true
5) you can't sell the photo, and in general you can have only turistic photos photos for some archeological or architectonical place if on this last there is the copyright of the architect.
this are the general lines for the laws, in practise you can't shots only near some military place, ma very fews, and the controls there are only near some airport but if they see that you are only a photographer there aren't problem. If you have a reflex often they are always on the front and you can't shot because they want appear on some newspaper :) |
