Well Heather had an interesting night. She was sitting around working on the computer when she heard a loud bang. She thought it was the washer/dryer but as she walked to the laundry room she smelt gun powder then looked down and saw a quarter sized hole. Our downstairs neighbor had shot his Russian assault rifle through the floor and up through our ceiling. The bullet turned into shrapnel. She was air drying our clothes on a wooden rack. It put holes all through the clothes we had just bought for our job interviews. The gun shot was extremely loud. She called 911...then me. The guy came up and started knocking on the door. She didn't answer. The police arrived and said that it was a
bad accident as he was cleaning his gun. Heather does not feel safe knowing he still has that gun. I'm going to talk to the apartment about moving out. The police said we are in our rights to leave without any penalties. I just thank God she wasn̢۪t walking there when it happened, or even our dog Sadie. I don't know what I would have done. Just another instance of how random things can turn out in a day you thought was normal.

Wow! That's kinda crazy. Oddly, a similar thing happened to me a few years back. Someone shot through my neighbors wall late at night and the whole was pretty close to my headboard. Luckily I was watching a movie in the living room.
Glad to hear everyone's alright. Sorry about your clothes :(

Im curious as to what gun he had it must have been something older. A Russian SKS or even an AK would be unloaded while cleaning unless your an idiot.

I really cant think of any assault rifle that woul loaded when cleaning. The only thing i can think of is when purging a muzzle loader using CO2 if it went off now that would be a legitamit freak accident while cleaning.

In fact every responsible gun owner knows they shouldnt have a weapon loaded while in the house he had no reason to. You also always keep the ammunition seperate during storage.

He will pay for the clothes wish I could get him to pay for moving costs also and a storage facility till we find a house.

wow thats crazy. cant believe hoe stupid some people are. good luck finding a new place, maybe this will put you someplace better.

I'm a very responsible gun owner, but each and every one of my guns is loaded just in case the rapist, burgular, thief, terrorist, etc. may breaks into my house has a rude awakening from my wife or me. Its hard to load a gun when someone is already in your bedroom and attacking you.

This person was careless and forgot to unload his gun before cleaning it. it happens, but hopefully no one will get hurt.

Van on that thought there are two loaded guns in my fathers house a Shotgun in the bedroom and down stairs in a wall gun safe that is covered by a small cabinet. The cabinet swings out you press a fingerpirnt and the door drops and out pops the gun.

On that note yes. But you wouldnt clean the trigger off while loaded and saftey off?

No, with three children, I definately unload them before transporting to the range or hunting. Clean them, then reload them for safety. :)

Check your lease. I'd be shocked if it DID NOT have a clause in it prohibiting all firearms there. He could and most likely should be evicted.

Lance, check OP's hometown state. I'd be surprised if there WAS such clause...

Im pretty used to big booms....I'm in Iraq. But glad to hear that you are ok along with your wife and pet. I would have to agree with everyone else. Time to bail and get a new place. GOOD LUCK

I'm surprised the police basically blew it off -- I mean, isn't there some sort of "unlawful discharge of a weapon" law or something? Just seems like if that would have happened around here, they would have been charged with *something*.

Requires proof of intent to discharge the weapon purposly in a manor harmful to others/property/environment and/or in violation local ordinance or state/federal law.

Something like that. You may be able to pursue it but if it comes up as an accident they dont have to charge them with anything i dont think.

I think it means that srdanz believes that Texas is pro gun.

Ah, I get it, although depending on where you live it could be a Management company policy and that management company is not necessarily based in Texas. Doesn't hurt to check the lease.

TRUE (every gun, for that matter)! Glad to hear everyone is OK. I have heard my fair share of accidental discharge stories...some including police officers, and I understand accidents happen...but this is why I take every precaution when handling firearms. Rule #1: ALWAYS point the muzzle in a SAFE direction. UP IS NOT ALWAYS SAFE! (as demonstrated in the OP's story). Even though you are in Texas, you still might check the lease...it could save you some trouble. Thanks for posting...I hope everyone can learn a little something from your story. Even if it is asking your neighbors about their gun ownership and training.
