Couple of issues here:
1. Evidence of crime. If the police need the photos as evidence, you have a legal duty to turn them over, and they can force you to do so by court order if necessary. Best to cooperate completely, but let them know that you are turning them over for the criminal investigation/prosecution. Let them know you have a copyright on the images, and do not want them generally released to the public or published in the news media without proper compensation.
2. Training materials. You do not have any legal duty to turn over images for training materials, so here a request for fair compensation for providing educational/training materials would make more sense. The only real issue is your future relationship with the police. If they have been giving you somewhat preferential treatment (better access) in the past, and you would like to continue getting such preferential treatment in the future, then maybe you let them use these pictures for their training (with copyright notices attached) and call it even. If you don't have any expectation of a future relationship, then you can be more insistent of course.
Your worry really ought to be allowing your pictures to go from you, to the police, to the newspapers or other publishers without proper compensation when the photos are used for a commercial purpose.
All of the above is, of course, just one knucklehead's opinion.

Ditto EarlBaker's response. I would provide them free of charge for ID purposes, but ask compensation for anything intended as training material. It's essentially an equipment acquisition for them. Write up a little contract that lays out proper use and method of compensation for anything beyond merely aiding in an investigation. They're professionals, and you are too.

Well, heres my update...Went to meet with the Captain today and he was unfortunately not there...hmmm no biggy. As I left the station I heard a call go out and it was two blocks away. Something about a foot pursuit. Sounds good to me. By the time I got there there were about 7 units out in front of a private home. Several officers were standing around a man with a VERY bloodied face. Needless to say they were not happy about me being there but being press credentialed they couldn't do anything. They tried to block my shots by standing in front of the suspect but failed and I managed some rather stunning shots of this guy bloodied and beaten. Appearantly he had stolen a ladies purse in a local grocery store and fled. A foot pursuit for a couple blocks and what they called resisting arrest aloud these fine officers to put a world of hurt on this guy. Well, I can pretty much forget about asking for compensation on those other shots. Now I will be begging forgiveness for shooting these. |

LOL! So much for selling photos to the police. Maybe you can sell the photos to the ambulance chaser who will sue the cops for police brutality! |

Maybe you can sell the most recent ones to internal affairs? Or to the bloodied up guys attorney. lol

DO you not realize that this poor slob was running with a purse in his hands........not something he is likely accustomed to... and that he in all probability lost his balance and fell... ergo the bloody nose.
That's my take on it anyway...Had nothing to do with the nice policeman who rushed over to provide him with solace and support.

I am rather intrigued by the initial portion of this comment, as you seem to suggest that the "Resisting arrest" factor is not true. Can you tell us just how you arrived at that conclusion... Is it based on fact, or mere speculation.
With regards to the latter portion of the comment, there is absolutely no need to beg forgiveness as you were merely doing your job, and I seriously doubt the police department would hold that against you. If you have gained their confidence and they grant you "priviledged" access, your actions in this instance should not have any negative impact on your relationship with them... at least not in my books.

Yeah, taht was my first thought too... Did you see them 'putting a world of hurt' on him?
Some people bleed easy.
I've seen kids do faceplants with nothing, but others who accidentally whap their face with a pencil that start gushing...
It's an interesting fact that people suffering from malnutrition often become very easy bleeders in the nose... As is possible for cocaine snorters...
I've assisted an arrest before, and while I didn't have to do a lot, even with the handcuffs on him and being held in my hand, the guy was pretty willing to give a bit of a rassle...
Over a matter of a 21 dollar theft...
Petty shoplifters are often the craziest whackos out there and are often totally willing to get themselves hurt for nothing... A good number of them also know a fair bit about how to abuse the system...
My sister is a junkie and knows all kinds of 'tricks' to get the police in trouble and possibly get charges dropped.
These sort are manipulative and opportunistic... I wouldn't put it past them... Nor would I shed a tear of a bloodied face... |

Just so everyone knows the suspect did in fact resist. He is lucky he wasn't Tasered. The officers warned him several times during the arrest to stop struggling or he would be Tazed. I am all for them kicking the crap out of the guy. He robbed an 80+ year old women. Sorry my humnor was lost in the first post. This guy definately got what he deserved. And as far as seeing what happened...yes I watched the whole thing unfold. I chose not to shoot the actual conflict. Something told me it was better to watch and capture the aftermath. Just my instincts. |
