I've been touting this site to a friend of mine and she's getting to the point where she'd like a place to sell her images.

After looking over my shoulder a fair bit I think she's almost ready to get a membership and make use of the DPCPrints perk too.

She has this really great photo of one of her cats in a leather jacket posed on a miniature model of a Harley. Its a fantastic image and she's had a number of friends wanting to purchase a copy. It is cute and funny and everything but I'm concerned that because it does have the Harley emblem and stuff clearly visible that she may be crossing the line into copyright issues.

Is this something she should worry about, or because she made the image and is just using the items as props, would she be okay? I've seen other photos on here for sale that do clearly show well known commercial products/trademarks but I figured I'd see what folks thought. Better safe than sorry!

She should be able to sell individual prints.

She probably cannot sell the image for further use (e.g. as a stock image) without cloning out the logo or getting a property release from H-D.

She should visit the US Copyright Office and read some of the documentation there.

Another good resource for info in IP law is Nolo Press.

Shoot a small copy to Harley's marketing office and see if they might want to use it :-) -seriously what's to lose, they are associated with toys-for-tots and stuff that might be able to use it also I think?

I think I agree with General on her ability to resell but it's a sad state that I cannot say one way or the other :-/

Yeah, she can sell individual prints. A quick look through DPCPrints will reveal quite a few Coc-Cola logos ;-)

But, really the only issues she would have with the HD photo is if she were selling stock. None of the stock agencies would touch it.

I'll let her know it should be okay.. and I think seeing if HD might be interested in it is a good idea. She's not too into the stock thing so that isn't a problem.
