I am unsure of to react on this, she didnt ask me for permission to use my photo, she took if off of a proofs cd that i gave to her to choose prints from, i dont know if i should be happy or pissed, what do you think, how would you act in a civil manner if you knew the person. ad to make it worse she blew up the small image and made it fit this and it looks like crap

I'm not sure if her motives were bad. You did state that she had a proofs CD. She might have asssumed that since she had the CD and she was the model that she had the right (and perhaps permission) to use them. Just erring on the side of misunderstanding.

i dont know ... i'll probably warn her, especially if you new each other.
and of course tell her that this is not nice thing to do, then hug each other to make it up :-)

im sure they werent bad, i just dont like how my photo got butched and she didnt even ask, im unsure my self,

the model release form doesnt say she has rights to the photographs that i do and i can use them in ways that are proper.

im not trying to make this into a war, do you think i should aproach her and say i am upset, or should i just let it go.

probably not, in reality, if i said anything to her, she is the type that would try and make trouble, so again, im still unsure, i really want to tell her thats not cool,
but at the same time, she is getting great exposure from this and i dont want to ruin it for her,
it sucks when you know the person,

there was no money involed at all, she bought some prints

probably not worth the troubles then.

But, the lesson that should be taken away from this is to maybe include some sort of usage statement on proof CDs from now on.

Did you give her full-sized pics on CD as proofs? I resize my proofs to 500dpi if I'm going to give them on CD - 90% of the time though I have the clients view proofs online.

know i have my website, that i use to show proofs, and there protected, so i dont have to worry about that anymore,

You should at least tell her to ask you in the future so you can give her a better file that willl only make her look better. And that when someone uses it for free they need to at least put your copyright notice on teh photo used.

yeah, i am not going to deal with her anymore, this is the second problem i have had with her,
she had put some of my photos on her myspace, and she had edited them and they look like crap so i told her thats cool if you want to market for me, but i wand to put my logo on the photos and edit them my way, and he fliped saying she didnt watn that

Live and learn. In future I would make sure that the proofs cd she receives is heavily watermarked on each image.

Something you can and should do is put a visible watermark with your name on the proofs themselves. Do this with all customers.

I think you should do some age-progression editing on her photos and post them up all over. Send her a link and ask her how she feels about that;)

Looks like you both had certain rights and they were exclusive of each others. You may want to change the release in the future that states; only final edited photos can be used by either party and use of proofs violate the copyright of the photographer.

I say personal... Self Promotion is fine..> But this looks like an AD for something. If she is making money off of it... There is a problem.

So need to find out what she is making and either Get a cut or threatin to sue. Friend or not... It is all Business.

Others will see you let it slide and think they can do the same pretty soon your known as the photographer everone can walk all over.

Stand up for your rights and deal with them.

This has been discussed on Better Photo as well.. she has been reported to flickr... but like slime she'll probably be hard to get rid of permanently!
