I'm sorry, but it's up to the police to make their case stand up in court. If they screw up, say, for example, they don't get their radar gun calibrated properly, how can they say how fast I was going? Maybe I wasn't speeding at all?
My friend got a ticket thrown out by asking the patrolman if his radar gun was calibrated and when that question was answered in the affirmative, asking for the calibration documents. The patrolman did not have them. Case Dismissed.
The Highway Patrol used to put dates on the bottom of the ticket that corresponded to dates when the patrolman would be on vacation or otherwise unavailable. Smart speeders would try to get their case moved to one of those days. Then, when the patrolman doesn't show, the judge has no recourse but to dismiss the case.
My friend got pulled over and ticketed for doing 56mph in a 55mph zone. I would never have believed such idiocy if I hadn't been in the car with her. The judge threw out the case when my friend showed documents indicating that the error on the particular model of radar gun was +/- 1mph, meaning that is was entirely possible she was in fact, not speeding. |
