I dont know how many of you post to or use tribe.net but there is some disturbing stuff going on over there.
They have changed their terms of use to include the following :
[quote]
We do not claim ownership of the content you post or otherwise provide to the Service. However, you hereby grant, and agree to grant as an effect of posting or otherwise providing content, to the public for non-commercial purposes and to Tribe, a perpetual license to use, copy, distribute, display, perform, and modify any and all content that you post on the Service. This license cannot be withdrawn. Your use of the service is in consideration for this license, we will not otherwise pay you for your content. You represent and warrant that you have not granted and will not grant any rights inconsistent with this license.
[unquote]
basically they are taking full editorial rights to anything that is posted on thir site...
does this even remotely sound right to anyone ...

Very similar to here.
Originally posted by Terms of Service: 6.2 You hereby grant DPChallenge.com a nonexclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise any rights you have in the Member Information and Media, and otherwise to make use of the Member Information and Media (including publishing, disseminating, broadcasting, manipulating, reproducing, editing, translating, performing, modifying, or displaying any part of the Member Information) and/or Media alone or as part of other work in any form, media, or technology whether now new known or hereafter developed, to enable DPChallenge.com to continue the specific operation or marketing of the site. This includes, but is certainly not limited to email "newsletters." |
It's standard, and the only real way to for the site to be able to keep the content that makes the site what it is.

so if you post you are putting the image in the public domain right ???
I expect that I I post to a site they have rights for Their use and marketing not PUBLIC rights

As I understand copyright laws (here in the US anyway), there is fair use allowed -- and non-commercial probably falls within it. It sounds like they are simply making clear what happens anyway. If your worried about it, don't post any images there -- or post links, then they are allowed to use the links, but not guaranteed the links will remain valid. ;)

I guess that the screaming has been very loud over there they are now having their lawyers look at it again... the problem that most are having is the license grant needed to operate the site is far too broad.
It would be like simply giving away all rights to an image (nonwithstanding the fair use doctrine and even that has limits)
oh well ... I was just seeing if anyone had any ideas on this ...
Thanks David |

No problem. I can imagine many are having issues with it -- I seem to recall there was a forum thread here when someone had an issue with the DPC TOS.
Found it, not really an issue; more of a curiousity that lead to a discussion -- here.
