Hi All

I discovered FOTOLIA.COM. Another microstock site. It ha a nice layout and a great uploading flow. It seems fairly new since they seem to apporve photos within 4-5 days. I think it has great potential.

lol

Why do you care?

I'm just curious - I mean they are sharing their micro links - everyone has them in their signature too.

Anyone "tricked" into signing up - what do they lose?

Lot's of BS in my signature. I've been thinking about Fotolia.com myself.

I haven't got time to go through all their terms etc right now, but I will look into it another day. Thanks for the info.

Am I reading correctly that Fotolia is basically exclusive? Photos uploaded there cannot be used ANYWHERE else? Would that not include posting on DPC, pbase, etc? What about the "derivative works" thing? That would mean lookalikes couldn't be challenge entries, right?

Just curious. I signed up, but I'm not sure what I'll put up there.

Fotolia doesn't require exclusivity. Like some other micro sites, you can, if you want, to grant them exclusivity. I don't see any gains for the photographer to do that. Imagine if Lisa Gagné from Istock started uploading to SS, ect... she'd be so rich so fast it wouldn,t even be funny!! :-) Her loss, our gain!! :-)

Does anyone else think it slightly rude to post links without expressly pointing out that they are referral links? I'm all for passing on referral links and have done so many times, both here and elsewhere, but I try to make a point of explaining that the link I have provided is a referral one (and may earn me some income if used). I doubt most people would have an issue with that, when told, but isn't it nice to give them the full picture?

Here are some other current threads with information (and links) to other agencies like this one:

I'm not a lawyer, but the part of me that wanted to be a lawyer is a little bit distrustful of this language...

"You may not use, reproduce, distribute, display or create derivative works based on any Works that appear on the Website unless you enter into a Content Download Agreement, and you may do so only to the extent expressly permitted under the terms and conditions of an applicable Content Download Agreement."

Hmmm. I understand this technically may be intended for the PURCHASER, but it is published in the general Terms of Service for the website. It is followed by "You acknowledge and agree that Fotolia or its licensors retain all ownership rights in and to the Works, and that such Works are covered and protected by copyright, trademark and other intellectual property rights of Fotolia or its licensors."

Not sure that couldn't be interpreted to be exclusive.

Woah.. what did you say about smooth upload flow... it is STINKIN SLOOOWWWWWWW... the ftp upload works nice.. but 3 pages of 'confirmation' for ONE image.. is a little overboard... it keeps me from uploading all my images.

Yes the upload process is a bit long, but I make money there so I don't mind....Plus I put most of my images up online one by one with Dial up internet last year before I got high speed....Now that was slow!

For most of us, I agree. However, Lise is a special case. Because she has sold so many images, they pay her a huge bonus to be exclusive.

I still haven't looked properly, but I think individual images do have to be exclusive there. Not sure that's the way I want to go. Some images do well on one site and badly somewhere else. If I give them exclusively to Fotolia, I just might choose ones that would have been best sellers somewhere else, yet they prove to be unpopular there.

I just signed up with them myself today, so we will see what happens. Would prefer to get into some of the macro sites but not good enough equipment to do so yet!
having problems with my signature...sorry for the additional edits
