Is the Sepia Toning under the Actions tabd in PS legal in basic editing rules?

Should be. All it does it to colorize using Hue/Saturation with the layer in Normal mode.

I haven't personally used this action, but if sion's description of how it operates is correct, then it is defintiely legal. There are a number of methods to do sepia under the basic rules.
