Same thing here. Tons of people "stole" images to participate in this activity. No one complained there either. You don't see people writing in "OMG, you stole my hair/guy mowing lawn/ Yoda photo".


I'm sorry Beagleboy but I am not familiar with those threads. I was only trying to address the case at hand.

*nodding* I'm fairly certain this goes on a lot in his life, not just DPChallenge and Fanatics....unfortunately but he points the finger at everyone else, not realizing he has 3 more pointing right back. :/ Very sad actually...

I understand yours and manics relationship and your need to defend him and his positions, but so far you could not be more wrong with your conclusions. I wasn't going to post to here again but certain attitudes just burn me up. So what if people use your images for fun on this site. If it was done on this site it would not make a difference to me. But it wasn't done on this site. The image was REMOVED from this site and used on a site that claims no affiliation to this one WITHOUT my permission. That is THEFT! You can try and justify it any way you like, but stealing is stealing. The image was not associated with me until I happened to log into fanatics last night and obviously it was common knowledge, or at least a lot of people there knew of its existence based on how many people used it.

And no not everyone who participated on the above mentioned threads should be hung. But they did use images without permission. On a site like this where we claim to be concerned about unauthorized use of our images and scour the net for their unauthorized use, I don't understand why it is allowed to freely use other's images without permission. Kind of two faced isn't it?

This has nothing to do with my relationship with Manic. Believe it or not, I am my own person and have my own opinions. It seems like you are the only that thinks this is theft. You've gotten apologies and the image has been removed, what else do you want?

I was going to send this message as a PM to the SC members that have posted to this thread, but decided to say it publically instead.

"It really bothers me the way all you SC guys are rallying around Manic, and taking his side against Alienyst. Does Alienyst really deserve to have to defend his sanity against uncalled for remarks from Manic's fiancee? Can't someone on SC step in and tell her to zip it? Such has been said to me a few times in the past when my mouth got carried away.

Would be nice if you could be a little more objective in your posts. And it would be nice to see someone in authority here stick up for what is at the bottom of every page at dpc. No matter who did it, or whether you consider it theft, the bottom line is that the man's image was used without permission. Own up to that fact and stop ganging up on the poor guy."

Why does this keep going back to me being Manic's fiance and defending him? I would have still posted the samt things if this was relating to someone else. Aren't we all entitled to our opinions? As I said earlier, I am my own person and he does not need anyone to defend him, I just don't agree with Alienyst side of the story because of the way he was acting last night. I do not think this is theft and I simply stated my opion on everyhting just like everyone else did.

I don't like this talk of theft, and reliance on a statement at the bottom of the page. People are too prescriptive over wording and are getting hung up over it.

In practice, people use other's images from this website to poke gentle fun at each other. I think that if you participate in the forums, you have to accept that it might happen to you. If you don't like it when it does, ask the authorities to remove the offending image, and it is done. If you never want it to happen, add an additional sentence to that effect in your bio.

It is not theft. It is not a material breach of the ToS. You had a remedy to stop or prevent it. In this case, the issue was remedied promptly.

I am sometimes very surprised by the infantile approach people take to resolving these issues - something about cyberspace affecting people's ability to resolve issues that they would deal with in a trice in real life.

I've posted a couple of times in this thread so I'll respond. I don't really feel that I've taken either "side." I did suggest to Alienyst that I do not at all believe that there was any malicious intent with this whole mess. He made many posts about his "nudie boy" picture, and everyone had a big laugh. So someone thought it would be funny to give him his own smiley, much the same way many users in chat have chosen their own smiley. Alienyst apparently did not think it was funny. Once this was clearly conveyed (as I believe it was not in the beginning, hence some of the surprise in this post) Manic did his best to remedy the situation immediately. My response has absolutely nothing to do with the fact that Manic is an SC member - it's based upon what I know of DPFanatics, who are, in general, a great, fun loving group of people. Those who are mean and malicious are banned from chat and had that been the intent of this, it just wouldn't have been carried out.

We're at a point now where there really isn't much else to be done. Alienyst has expressed his opinion, Manic has complied with his requests. There was no intended ill-will, no one is going to be banned or punished for a joke that was taken the wrong way. If Alienyst has further issues, he's welcome to contact the Site Council or the Admins. The same goes for anyone else. At this point, this thread serves no further purpose and I am locking it.

I locked it. The words below are not mine, but I agree:

Images used from this site for parody or other lawful activity (please refer to US copyright laws for a full description of lawful and unlawful use of images copyrighted by others) in no way impact DPC's liability with respect to those images. It is our understanding that an image was used without permission, whether lawful or not, and that derrivative image has been removed from an unassociated site.

This thread is being locked because the underlying issue has been resolved and the questions posed at the start of this thread have been answered. This thread has outlived its usefulness and is devolving into namecalling and conspiracy theories which undermine the harmony and community of DPC.
