I was browsing Smugmug looking for infrared groups to either join or start one myself and came across this one:
Robert Cain Gallery

which states that all the photos (1500 of them) are NOT his. I don't see any photographer names or credits given, and perhaps he has permission of all to showcase them, but I thought I would post it here so that you guys can check to see if any of these are yours - just in case :)

I don't shoot infared technology. There is someone here who does that though.

Perhaps you could write Smugmug and alert them. Especially because he has ordering enabled.

Thanks ButterflySis. I hadn't noticed that he was selling them! I did alert Smugmug to this situation.

i refuse to look at over 1500 photos lol
they are all awesome though

Are people that stupid? What on earth makes people think that they can legitimately sell other people's photos?

I mean, I can understand it if you're just ripping someone off or you like to make money illegally...but to think that what you're doing is perfectly fine!?! Sheesh!

I contacted smugmug and this was the reply I got:

Hi Deannda,

Thanks for contacting smugmug. In this case, it looks like it is a simple mistake and not malicious intent. He has not marked up prices, so he is making no profit on those prints... he probably just forgot to turn off printing in the galleries. It is provided as a convenience to all account owners, but in this case he is not turning a profit at all. I will drop him a not and let him know of his mistake.

Thanks for checking into it. Personally if it was one of my pictures, profit or not I would be ticked that someone took and posted it without permission or credit.

Anyway you look at it, the info on the site says that the person who posted the shot has copyright on the shot and that's not true in this case.

It's also possible for someone to legally sell images created by someone else. I have several prints for sale which are of original collages created for me by another artist. I own the copyrights, although I certainly credit the creator as well.

It is well to question and investigate, but not to assume ....

This is true and this was smugmug's reply to my last email:

Hi Deannda,

I agree, so I sort of suggested to him that he might want to think about the legality. Smugmug states in our Terms of Use that we respect copyrights.
