First, can uprez software, such as Genuine Fractals and Q-Image, increase resolution of our photos on DPC to produces files that would print out high quality photographs? If so, then what's to stop someone from stealing our photos and using this software in such a manner and selling these prints in some far off place?

Secondly, could it conceivably be argued, say in court, that since the interpolation these programs perfom add pixels non-existent in the original file, that the copyright of the given image does not apply to the upsampled one?

Nothing will stop the determined thief. You are protected by odds only -- out of seven billion images online, will they pick yours?

Your copyright is still valid for any new image, because your original copyright includes the control over the creation of derivative works as well as copies.

Possibly, depending on the initial image, compression, and size of the target print.

Nothing except that there are easier targets elsewhere (larger images, for example)

Sure it could. It could be argued in court that pigs can fly, too. Neither argument would be likely to be successful.
