I searched & could find an answer (or my search was poor ;)
my editor of choice Nikon Capture has a tool called 'D-lighting'
which can occasionally bring out some detail in shadows
is this a legal tool in advanced or basic editing ?
(yes yes yes on the whole image -
Capture preserves the original image - all images can be reverted to orig. NEF)

Although I don't have Nikon capture to judge for myself, I'm assuming (correct me if I am wrong) that this works a bit like Photoshop's shadow/highlight tool, which is considered legal in both basic (when applied to the whole image, of course) and advanced.
