Back in January I shot a model, Audrey Vasquez. She has contacted me informing that Robert Garcia from Bonita Magazine in San Jose, CA has requested her to submit photos to his magazine and she wishes to use a few photos that I took.
What is the standard agreement when submitting to a publication? Are they buying the rights and ownership from the model/photographer or is it just a licensing agreement? Do they pay the model/photographer for pictures? I'd just like my fair share if money will be exchanged.
I responded to her email by asking her to provide details of the agreement before I draw up a release. This should buy me some time as well as get some answers from the pros here.

I don't know about releases but would think this all hinges around the agreement you had with the model when you took the shots, are they your photographs or theirs?

I own the copyrights to the photos as well as rights to do anything I wish with them, including selling them. I'll have to double check our contract to see if she retains any resale rights or if those were waived.
Basically, I own the photos and the magazine needs my permission to use them. I shall be contacting the magazine soon as to see what extent they plan to use my photos and the terms of their agreement.
