CHICAGO (AP) - An appeals court said a man can press a claim for emotional distress after learning a former lover had used his sperm to have a baby. But he can't claim theft, the ruling said, because the sperm were hers to keep.
apparently she saved the sperm from oral sex and used it to have a baby.
when he tried to sue the lawyers said, "She asserts that when plaintiff 'delivered' his sperm, it was a gift - an absolute and irrevocable transfer of title to property from a donor to a donee," the decision said. "There was no agreement that the original deposit would be returned upon request."

I would appeal that... It's one thing if the gift had made its way down the original pathway and fertilized the egg, but in this instance the donee surreptitiously transfered the gift, and used it for purposes other than those intended by the doner.
Just a thought...

That's for sure. She needs to take a bit of responsibility for her actions. He was not in any way responsible for that pregnancy -- she determined that on her own and behind his back (so to speak). :)
But I can't feel sorry for either of them, only for the child being raised by a parent with that low a level of ethics.
