John - If the site is really down, then you need to talk with your developer because much of it is still there. For example, check out this url: //www.jfalkphoto.com/port1.htm. What has happened is the main entry link has been "disabled" by removing the main images that have the "links" to the rest of the site. However, if your site was indexed by any spyders/bots (which is most likely), other urls will still work to get into the website in question (they are indexed to be pulled using internet search engines).

I would make sure that ALL images that were imported are deleted from the web server immediately. That would help defuse this situation...

It hasn't been indexed by Google. I checked.

Good way to get lots of hits, hehe. Totally low. If he has indeed copied then he's letting himself down as a photographer but we live in a democracy so he is innocent until proven otherwise.

PS, the fake site did'nt load for me so maybe I can't see the proof.

Not Good whatever way it pans out. Maybe you should put your name on the images somewhere.

I absolutely agree. Whilst it's important to stand up for one's rights (and the rights of members of one's community) it's also good not to make negative assumptions about other peoples' motivations based on one's own knowledge.

Let's not make this into a witch hunt.

My question is this did you look at your site?????? If you did you know you had Mr. Ascough's pictures up there and should never had posted it or left it up for one minute. You maybe new to this but did you not look. If you hired this out I would fire them and go to an honest developer.

I also think that we can let this drop. The offending material has been removed, Mr. Falk has apologized and is now clearly aware of the nature of copyright.

Please keep in mind that MANY of us are guilty of violating copyright. I know of at least one user on the site who is using an image without my express permission. It's a desktop selection, so I'm not too worried. I know that others have copied images from DPC to their hard drives to use as inspiration for their photography. And I'm pretty darned sure that most of us have a pirated DVD, CD, MP3, or software either currently on the computer or have had it at a previous time.

Have you ever scanned an old wedding photo to your comptuer? Made prints of that old photo done in the 70s? If you don't have a written release or negatives that's a copyright violation. (In the US that is). Fair use does not apply to photographs. If you think it does, just walk into a photo place and try getting the copies of pro work done. :)

This in no way condones what happened here. Just keep in mind-before you cast stones at Mr. Falk, make sure that your own copyright history is squeaky clean.

I can pretty much guarantee no spiders have crawled this site. it took my 6 months to get even one search engine to list my DJ site with full meta tags and TONS of submissions to search engine 'please spider me' sites.

John, if your web host provided you with an interface that allowed you to upload a whole site from your harddrive, or a developer did this for you, you should probably for now contact the developer or try an FTP program like CUTEFTP to completely eliminate any pages that remain on your webhosting root.

For those that are curious you can easily get information on most registered websites using this url: //www.networksolutions.com/en_US/whois/index.jhtml

Put jfalkphoto.com in the domain name search location. I'll leave looking at the results up to you, but do take the time to scroll all the way to the bottom of the search results - it shows the Current Registrar (I'm pretty sure this is the business that built the site).

Nice to see that everyone is so understanding.

It would seem that the man made a mistake, has recognized it, apologized for his actions and is striving to rectify the situation. In essence, the unfolding of events from my perspective that would tend to indicate that his actions border more in the realm of ineptness, as opposed to criminal intent. Viewed in this light, perhaps a bit of leniency might be in order.

On the other hand, if indeed the aggrieved party did call this person's wife at 0200hrs and speak harshly with her, then that is one action that I personally would find repugnant.

Stated succinctly, all of this could have been dealt with in a more calm and rational manner by the parties involved, perhaps in a more private setting.

Just a thought,
